Received a PNC for parking in a disabled parking bay (I’m a wheelchair user)

I went shopping today at Crown wharf retail park in Walsall. I parked in a disabled bay which I’m entitled to do so as I hold of Blue Badge. On returning to my vehicle I found I had been issued a PNC notice from CP plus using the code that the badge was not on display. The PNC is requesting £100 reduced to £50 if paid in 14 days
The badge was on my dashboard when I left my vehicle but on arriving back from shopping my blue badge was in my foot well. Can someone please explain the best way that I can appeal this PNC notice.
This is a lease vehicle under the mobility scheme and I’m not sure how to proceed with the appeal. Any advice would be greatly received

Send the initial appeal template from the NEWBIES FAQ sticky, post #1. It is carefully written so that the driver is not inadvertently identified.
You can add a final paragraph to state that an occupant of the car is a wheelchair user, the disabled bay was correctly used - and here is a copy of the Blue Badge as confirmation so that a cancellation can be quickly issued.
Add, that should there be no cancellation, there is the intention to sue the Crown Wharf landowners under the Equality Act 2010.
CP Plus very often cancel on receipt of the forum's template.
Have you contacted the retail park managing agents who can also order a cancellation? Do that on Monday.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Parking Weasels have been known to rock cars to dislodge tickets/ badges I am told.
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
As above, it is quite possible that a person or persons unknown bounced up and down on the car to deliberately dislodge the BB. What a jolly jape. You have to ask yourself, who gains by such an act? There is only one entity, and possibly an employee of said entity gets a bonus for every ticket issued.
Follow the guidance of Umkomaas and send the blue text template from the NEWBIES with the addition of the comments he has suggested.
Definitely complain to the retail park manager/CEO, mentioning the BB was displayed when the car was parked, and there is only one entity that would gain from dislodging it.
