    BW will not be there, and no, I would not try that. BW do not attend cases. That is NOT to say no-one will.

    So my hearing is on Tuesday, im preparing by making sure I know my arguments inside out etc. Is there any tips for the hearing ?
    I have also realised that I forgot to alter the loss of earnings amount in my costs schedule at the time I wrote it I didn’t realise £95 was the most you could claim. Shall I just take an amended one with me on the day ?

    Yes, take a revised Cost Schedule on the day. Claiming less on your revised schedule is unlikely to be a problem. Take two, one for the Claimant and one for the court.

    Hearing was today thank you all for you help
    It was a win !

    I wasn’t feeling very hopeful as there was 4 cases before me all with KBT and KBT won each case with the defendants paying over £200. One or Bw legals representative was smug as hell walking round the waiting room.

    I was in all of 10 minutes and barely had to say a thing as the judge pulled bw legal and KBT evidence / witness statement apart.

    The judge was looking at the contract between KBT and the land owner which actually turned out to not be with the land owner but with a management company that manage the land.

    The judge also said she couldn’t work out where they were trying to say was the area that they were able to patrol. As the address that was given is infant for some houses and not actually a car park or parking site.
    Left BW’s rep stumbling and with nothing to say.

    Dismissed the case and I was awarded £75 in costs
