    I just meant at some point tomorrow. Just see it be Ming very unlikely that if they haven’t made it there already that they will before 4 and also my copy.

    Should it’s be updated on MCOL that I have submitted witness statement etc? If it hasn’t do i need to ring to get that updated ?

    Also still yet to receive anything from BW legal am I likely to hear from the court between now and hearing date ?

    After the Claim is assigned to the hearing court, the CCBC play no further part. Thus MCOL will not be updated when you file your Witness Statement and evidence.

    So I have today received bw legals witness statement. In their evidence they have included images of the sign at the location which they did not provide me in the SAR. I didn’t append the whole SAR as I didn’t see necessary only the photos relevant to what I was saying. Is this something I can then argue in the hearing ?

    Images of a sign are not personal data so whoever you sent the SAR to had no obligation to return them in response to that SAR.

    I’m not feeling very confident now receiving their witness statement and evidence might just be as it’s now more real and hearing not that far away.

    Will I hear from the court again before the hearing ?

    It's sort of called crunch time. You know that BWL added on a fake amount, you know what the law says about this, you want the judge to ask BWL what is their authority to obstruct the law.

    BWL will not be confident given their track record of being spanked by the courts.

    BWL send a rookie freshman to court mostly with a lack of information. Once a judge gets into asking about the fake £60, feel sorry for the rookie

    no , if the court gave you a hearing date and a deadline for the WS statement , then you should have dropped off 3 items


    WITNESS STATEMENT
    EXHIBITS to back up your WS
    Costs Schedule


    ENSURE that you do any missing items asap , especially the costs schedule , to court and to the claimant


    if its discontinued you should hear about it , but not if the hearing date arrives

    Don't be put off by BW Legal's template WS; everyone gets those pages!

    Your evidence is GOOD if you appended the Jopson case and talked about grace periods to load/unload. Remember to tell the Judge on the day that the Jopson case is persuasive as it was on appeal and dealt with matters of similar facts.

    Do not let it be said that this was 'just a county court case'. No, correct that if assumed.

    Ok thanks feeling more confident about it again now. I am a little confused a to when I’m meant to submit skeleton argument or should I have done this with everything I submitted this week ?

    Also am I right I’m saying I want to ask I BW have “right of audience” at the start of the hearing ?
