    As far as I can tell then, this is a dispute about a parking fee due to being given incorrect information and inadequate signage.

    It isn't about fighting a Parking Charge Notice. That's why there was no PCN/NTD, no NTK, and no offer of PoPLA.

    This truly is a completely different gether all tomatter.

    I don't know if any of the regulars will be able to help with this, and I'm not sure what to advise.

    Of course, the PPC may still send a PCN as well if this isn't resolved and we can help with that.

    Clamping and preventing a car from leaving a car ark were banned in 2012 with the introduction of the PoFA 2012. Forcing you to sign something in order for you to leave may have been an offence.
    Giving "false" information, whether deliberately or by accident, and allowing the vehicle into the car park could be entrapment.


    Sheila at Bailiff Advice Online may be able to help with advice about an alleged debt and how to stop this escalating. She posts here as Herbie21 and has a very good reputation on this forum, although I have never used her services myself.

    There is another site with a similar name. Make sure you use the one with the open law book on its home page.

    You could offer to pay them the amount you would have paid in the correct car park as a gesture of good will.
    NCP may try the small claims court if this isn't resolved, in which case the guide to court in post 2 of the NEWBIES is still valid.

    "Drop off" just means its a very expensive per minute car park, it has no special status.

    Keith 9/10 i would agree you and say yes things are often best done on an open forum but this case is slightly different,
    I have on behalf of a couple of people negotiated a couple cases down to the bottom of the barrel dealing directly with the operator, its a fair amount of money so this kind of approach is probably better.
    The OP is of course welcome not to take me up on my offer.

    In all honesty I think your only "crime" is being a little naive thinking that such a convenient car park so close to the terminal was the long term car park you booked.


    It looks like you turned one exit late on the roundabout and ended up in the Drop and Go park which has a ridiculous price of £30 for every 60 minutes or £50 for every 60 minutes in the premium area.


    Birmingham airport seem to think their signage is clear I would dispute that.


    Like most airports, and I use Heathrow and Gatwick frequently you certainly need your wits about you to negotiate their roadways and minimum at the last minute signage.


    If Brown Trout has experience of this type of underpayment claim and how to deal with I'm sure as Kieth has said we would all be interested, but obviously if it needs to be kept under wraps so be it.


    I can't see how NCP can or would want to use the normal BPA PCN route with this one as that could only net them £100 or the reduced £50 if paid within 14 days which in your case would be a bargain.


    If they are pursuing their original charges I would think this would go straight to a small claim in my humble opinion.

    We always advise people to never take advice via PM especially not from people who joined within the last month. PPC employees lurk in this forum creating mischief. Anything that needs discussion can be done in the open forum.

    BTW This case has nothing to do with PCNs NTKs POFA POPLA or any other acronyms as it is purely a case of a disputed invoice for services. NCP will have up to six years to take this to court but by the OP's account this is likely to fail on the basis of promissory estoppel.

    I've been around for donkeys years thanks:) nor am I employed by a PPC ..Good grief :) but it's up to the OP if they want my help to get this of their back or not.

    That's exactly what you would say if you were employed by a PPC.:)

    My advice to the OP remains the same. Conduct all business on forum & do not discuss your case with anyone by PM unless it is a reliable longstanding forum member like SRM or bargepole who PMs you.

    I make that £490 a day. I am sure they will record those barrier conversations, and you should be able to obtain a copy, but presumably what has been recorded will either help you or help them.
