Pothole Claim
Hi! First time posting. I am based in Glasgow. I have been following MSE guidance on reporting and claiming compensation for damage caused by a large pothole. Glasgow City Council have accepted responsibility but have rejected compensation citing that the roads are inspected on a regular basis. As advised by MSE I sent a Freedom of Information (FOI) request. They have come back to me and changed it from FOI to Environmental Information (Scotland( Regulations 2004 and have issued a charge. Interestingly I was directed to Scottish Information Commissioner (as does MSE). As far as I can read the Scottish Information Commissioner refers to this as a Freedom of Information request and there should be no charge. I have obviously complained and submitted my evidence. Has anyone else had this experience? I am pursuing full compensation as I had just pulled away from lights in a long line of slow moving rush hour traffic, in darkness, no street lighting where I hit a huge pothole that blew out both my front and rear driver tyres (which were less than 6 weeks old).
