Hi all,
The SRA have replied to my complaint about BWLegal's harrassment, to which I attached a call log, a text log, an email log and an example of their constant letters about 'my account' with them. Here is their reply:

Our understanding of your concerns
From the information you sent us, we understand BW Legal Services Ltd acts on behalf of Britannia Parking Group (BPG) in the recovery of unpaid penalty charge notices. You say you have received harassing communications from the firm and the letters you have received contain threatening language. You are also concerned that the firm is inflating the claim by adding its legal costs.
Our assessment
We have looked carefully at the information you sent us, but we did not see sufficient evidence of professional misconduct on which to base a regulatory investigation. In reaching this view, we considered your report alongside all the information we hold about the firm. Our records do not show that the issues you complain of form a concerning pattern of behaviour.
It may also help to explain that as you are not the firm’s client the firm owes limited duties to you. The firm is entitled to act on the instructions and in the best interests of its client. We have considered the evidence which you have sent in. Although the firm’s communication is robust, we cannot make a finding that there has been professional misconduct.
Taking all this into account there is nothing to suggest a wider concern about the firm’s skills, knowledge or behaviour. As a result, we will not be taking any further action at this time.
You may wish to seek independent legal advice regarding your matter. The Law Society’s searching tool ‘Find a Solicitor’ could help. There are also further useful resources on the Legal Choice’s website in relation to the types of lawyers and funding options that you could consider. You may also wish to visit your local Citizens Advice Bureau or law centre, who maybe able to assist and provide you with further guidance.

The same whitewash we have seen with other complaints to the SRA.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Bit worrying isn't it? I guess if enough people keep complaining they have to do something. I notice they report publicly on the number of complaints they receive if they exceed a certain threshold.0

I got one like that two years ago. Sooner or later the SRA may find itself in the dock for these blatant attempts to protect its members. Get your MP involved.
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

The Law Society says ....
All solicitors must comply with the professional ethics and standards, which are set by the Solicitors Regulation Authority (SRA).
The SRA are ignoring their own principals on how a solicitor should behave.
It may also help to explain that as you are not the firm’s client the firm owes limited duties to you.
Does this mean that their solicitors are allowed to act like the Kray Twins with no DUE care and attention for the public ???
