Council Housing for Undischarged Bankrupt

Hi all,

My scenario is that couple of month back I declared bankrupt myself due to credit card debts. Currently, in private rented property with no overdue rent. I am bidding for council housing for last few years and currently within distance of getting one because of my bidding position. Now, I am worrying, as I am undischarged bankrupt will they accept me if my number comes ? I asked citizen advice, but they couldn't answer properly.


Do you have any idea either bankruptcy will effect on my application for council housing or not ?

    My ex son in law and his partner were bidding for 10 years so it depends on circumstances and how many in the house.. they lived in 2 bed accommodation with 3 children but they were both working so not sure if that was a problem also in an area where social housing was very limited ..other criteria seemed to go above them so who knows

    BR does not affect your eligibility for council housing. Councils do not to credit searches for renting council houses but may do an affordability checks with you to ensure you can afford to pay the rent and priority bills like Council Tax. Eligibility is based on your need for housing.

    What actually they do while checking affordability? Obviously, me & my wife working and also getting housing benefits to cover all bills, expenses. After bankrupt declaration, now my incoming/outgoing seems alright as no debt repayment. Because of that I can afford private rented flat. If they don't check credit report or consider bankruptcy issue, then I am ok...bit nervous...:)

    Its usually a basic check where you list your outgoings and income. It will show whether you are eligible for housing benefit but its usually done after you are allocated a property - not before.
    If you are an undischarged BR you will of course need to let the OR know if you have moved and you may have to do a new SoA due to change of circumstances - if the council rent is lower than the private rent - then you may end up with an IPA if there is a 'surplus'. If you are successful bidding, then get some advice on the BR and Living with it board about your SoA before you submit it.

    The council will not refuse your application because you are BR.
