Failed to buy parking ticket - is it worth trying to fight it?

Hi,
My first post - so please be gentle.
Background to story - a couple of years ago, a small local frozen food supermarket installed a ticket machine in their small outdoor car park.
This required you to buy a ticket if you were going to go into the shop, even if was for a short period of time or you were not going to buy anything - with fairly clear and explicit instructions on what would happen if you didn't.
For the first few months, people bought tickets but then, as there was never any sign of a parking attendant, most people stopped buying them.
Recently a driver parked their car, as usual, but was upset and surprised to find a parking attendant in the car park, who had just put a ticket on their car - from myparkingcharge.
Despite having a conversation with the ticket warden, 'it was out of his hands' as a 'photograph had already been sent.'
As it is from myparkingcharge, is it worth trying to appeal (based on habit maybe?) despite the circumstances ?

It's amazing that this small supermarket is still in business by employing scammers.
It depends on the signs now, are they clear can they form a contract.
I suspect that the owner who installed the pay machines is not getting the revenue he wanted
Myparkingcharge is a payment portal, on the ticket it should show

Ok -
So now the registered keeper has received the parking charge notice
with the usual bit about the payment required being £100 plus additional costs incurred through debt recovery and / or court action, reduced down to £60 if paid within 14 days.
It gives the option of paying the charge or , if they were not the driver at the time, letting Excel Parking services their name, address and passing the notice onto them.
What is the most sensible next step ?
is it worth appealing ?

The charge of £100 is in small type at the bottom of the sign and probably does not comply with the C of P of the IPC.
Also, the T&C are not on the sign, and it makes no mention of POFA keeper liability.
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
Much as I disagree with parking scammers, not paying to park every time you visit the shop because you haven't seen anyone checking does not sound like a scam or a valid reason to appeal.
The shop needs to keep spaces free for customers, they offer a pay and display to stop none customers presumably parking all day or parking and leaving the site. If you buy a ticket there is np scam.Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.0
