I understand frustration of contract but that is normally used when the PDT machine is broken or the PayGo app doesn't work. There is another (Latin) term and it was referred to yesterday in a post and (you know how many posts there are per day) I cannot find it!
If it was either 'Promissory Estoppel' or 'Contra Proferentem' (the ones most used here), neither apply.
But it may be something quite different that you read.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
