I understand frustration of contract but that is normally used when the PDT machine is broken or the PayGo app doesn't work. There is another (Latin) term and it was referred to yesterday in a post and (you know how many posts there are per day) I cannot find it!

If it was either 'Promissory Estoppel' or 'Contra Proferentem' (the ones most used here), neither apply.

But it may be something quite different that you read.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for your help everyone, I shall have to let it drop, as it wasn't any of the suggestions. I am sure I will come across it in my readings!
  • Hi all,

I haven't received the directions questionnaire as yet so have downloaded and filled it out, printed signed and scanned back in. Do I have to send this via post or can I send in email?

    Thanks

Found it! It is vicissitude - a change of circumstance or fortune! Not Latin at all. It was in post by Fruitcake - duly thanked.

You can send by e-mail to, I believe the same e-mail address where you sent your defence.
