CIFAS marker from littlewoods!?!

Having said that to place a CIFAS marker, there needs to be evidence that would stand up in court. There isn't. A court of law assumes innocent until proven guilty, not the other way round. Not having evidence to the contrary does not mean it's OK to load a CIFAS marker. Instead they needed evidence to prove that fraud was committed.
However, there are many documented cases where markers are applied without such evidence. From what I understand, you can be hit with a marker on suspicion of fraud. Such a system is clearly deplorable, but it's what our regulators and legislators have let them get away with.0 -
Try and see it from their position - a customer ordered goods to an address that they didn't really live at, and then didn't pay for the goods. The customer didn't get in touch, they just vanished. They've slapped the marker on your account to protect other companies. Get in touch with Littlewoods, explain the circumstances and come to an arrangement to pay. They may remove the marker, they may not.0

Unless OPs parents told them when they came looking 1. We don’t know her or 2. She never lived here.
Then they could assume fraud had been committed no0 -

Like I said earlier: tell them it wasn't fraud, and you'll pay in full, only on condition that they remove the marker, otherwise … no way, Jose .0 -

One more thing on the point you make, most people (not talking about the op here) who have such a marker whether suspicion of fraud or the whole hog fraud on their CIFA will attempt to sort it out I am sure of it, if you are proven not to have committed fraud then it will be removed if you are proven to have committed fraud then it means it will not.? If you do nothing it will not go away.
Isn’t it much like if you’re arrested and put on bail the end result will be you are released or you will be charged, depending on the evidence?0 -
Thank you for all the replies! I really do appreciate it, yes I suppose it did sound like I was not bothered by not repaying the debt but truthfully I was in a dreadful situation 4 years ago but it’s all changed and somehow I have a great well paid job I’ve paid off 4 out of 6 defaults and had them fully settled in the last few months because I want to improving my credit score but it all has no real affect until I can remove the cifas marker, I don’t need the credit but I have to have something in order to build my credit back up. I do have a Monzo account but it would be so much nicer to have a high street bank again.
from what I’ve read they must have evidence to submit these types of fraud markers because it has such a huge impact on people’s lives.
So from the comments I do have old bank statements from which the address and direct debit details will match. Could I use this in my appeal? Really just want to know if an electoral roll search is enough to warrant evidence against for this marker.
what are my chances of appealing to Littlewoods and how would I word it?0 -
You will need to follow the process detailed here. If you do owe Littkewoods any money, I suggest you clear this up at the time of your appeal. It will take some time!Blackbeard_of_Perranporth wrote: »There, all you need to know.

I doubt OP will be getting a bank account soon!0 -
Its not your score your improving, lenders dont see it, your history is whats important and its what lenders see, check out some of the other yhreads here.
All that should concern you is if the history is correct.0
