Really? By what law?0 -
I would start the process of adverse possession now The fact they purchased a piece of land has no bearing on the unregistered part.
The solicitor has said nothing apart from waffle that his clients have rights over this.He knows they do not.I think now they are aware its unregistered land they will obviously be looking into how they can obtain the land.0 -
Hello DoaM,
Following everyone's super advice I had sent a letter to their solicitor with a copy of the map and highlighted where I park my car. I directly asked if the neighbour had any access rights I was unaware of and the only letter I have received since then is the one I've mentioned. I'm not sure if this was sent first and I may get another one later. I really don't like to see these letters come through the post as they make me feel miserable.
I am going for a coffee with a lovely new friend this morning who used to live in the house where I am now. She had heard of the difficulties I was having and sent me a lovely letter of support. She said she thinks that when the previous owner (my new neighbour) of that house didn't own that land (that they have now bought and are now trying to use for additional access) they were allowed to access it to maintain their hedges. These hedges have now been cut down and replaced with a fence and that access only related to the land that was owned and not the unregistered land.
She has shown me some old maps which suggest that the land was a part of my property at some stage - some 19th Century Ordnance Suvey Maps but it looks like over the years this little pocket has not been registered or was sold on to someone else (which is odd as it would have been a small patch of land unconnected to anythin else).
Her support has been amazing but I don't think the information she has shared with me is enough to help me achieve adverse possession without the worry.
The official search of the index map of HM Land Registry (paid £4) has come back as stating that the land is unregistered and there is no mention of any access rights over it. It also says that they acknowledge I am the first to register an interest (or something like that as I'm not at home and can't see the exact wording!).
I know people think I'm being silly if I push this when I'm worried but I get the feeling that I am being bullied out of something. If the neighbour can prove I can't park there then I understand that and will comply.0 -

I raised this issue with my solicitor before I bought my current house. There's a strip of unregistered land of about 20ft from my driveway to the road.
No-one is able to park, build, put a static home on that land in such a way that it would restrict access to my property. Someone may be able to buy it, but they would have to continue to allow me unrestricted access.
There's a lot of unregistered/unadopted land in the country. That doesn't mean it's fair game for anyone to do what they want to it.0 -
Just reply to the solicitor informing that they have not provided the evidence you asked for and so will not be entertaining any further discussions until they do so.
Keep it very breifChanging the world, one sarcastic comment at a time.0 -

might be worth some effort to see if there are some old deeds/docs still hanging about from before the properties were built and the land split up.0 -
It is possible that they are trying to get hold of that piece of land by default.0

Hello Lucky Duck,
Do you think your cirumstance is because this is the only access to your house?
The original land that my neighbour has bought does not show any access rights apart from the bushes comment and the index search showns nothing at all on the unregistered land. This does make sense because looking at the old maps there was only ever an orchard on the site of the newer houses.0 -
Hello MercDriver,
It does seem that way...0 -
Hello Brewthebear,
I am soooo tempted just to do what you say. I am holding back just to hear everyone's thoughts on this. I certainly feel more confident to give it a try based upon the support I've been getting.0
