fixtures and fittings

FTB - offer has been accepted and just waiting for completion. We were told from the beginning when asked what would be left etc that the washing machine would definitely be included as it is integrated in the kitchen. we got the list of fixtures and fittings through last week and the sellers have ticked they are taking the washing machine. At first i thought it was an error so contacted our solicitor. They have come back today to say the sellers who are buying a new build have been told a washing machine is not incuded with their new build so are having to pay an additional 275 +VAT. They are therefore asking us to pay a fee as a 'good will gesture' for them to leave the washing machine. Is this cheeky of them to do? we are already paying an amount with the actual purchase price and were told from the get go and when we put the offer in it was being left. if the washing machine is integrated, dont they have to leave it? This seems to be what everyone is telling me, and it would be more trouble than its worth for them to take it out
any advice appreciated.

    Howmuch are they asking for?
    How old is their w/machine?
    Does it work - ask to come and test it!?


    Or just tellthemyou either want it included in thepurchase price as previously understood, or you they should remove it.


    You can pick one upat an auction house for £5 - £10.
  • They want us to offer an amount.
    The washing machine is a year old.
    But we could pay for it now and it could be broken by the time we move in and we wouldn't know.

    Offer then -£1 as a gesture (yes minus). I doubt they will take it.


    Current houses previous owners kepty asking for money for (horrible) carpets and blinds and stuff. Said no, they did not take it. I wish they had taken it. (including oven that had obviosuly never been cleaned).

    No, they're asking you to buy their second-hand washing machine, because they now have a choice of taking it or buying a new one.

    Not if they've put on the F&F list that it's not being left.

    The default is that everything fixed is part of the property, everything loose is not. But that's superceded by the F&F list that's part of the exchanged contract.

    So how much are they asking you pay to buy their second-hand washing machine?

    Is it a good make, well-priced well-maintained and under warranty/guarantee and with a receipt from a local store?

    Otherwise, say you're not a gambler and you're happy for them to take it if they can be bothered and you'll buy a new model that you can trust and you'll get full use of.

    It would be very unusual for the vendors new build to be built for an integrated machine then not have one. More likely there will be a space and “plumbing for washing machine” in their future home.

    An integrated machine is ugly without the appliance kitchen door fitted as it has hinges, magnets and a bump stop. My guess is they won’t take it once they consider this.

    Another option is to tell them to take it but make good the kitchen unit. This will be a pain as a chippy will have to come and hang the appliance door on new hinges.

    Final thing, is it a washer or washer dryer? Almost all washer dryers have really poor performance so if it’s anything but a Neff or equivalent washer dryer, then it will be rubbish. Ignore this paragraph if it’s just a washing machine.

    The buying and selling system could be altered in E&W such that this was agreed upfront, at time of offer, if there was the will to do it from the buying and selling public. Given the number of posts that appear here, similar to this OP's, IMHO it would bring considerable benefit.

    It's already done this way in Scotland. The F&F list is decided at acceptance of offer by a combination of what is stated to be included/excluded in the sales particulars, what is stated in the offer clauses, and what was actually seen by the viewer/buyer in the property.

    Typical standard clause;

    "The Properly is sold with:
    (a) all heritable fittings and fixtures;
    (b) all items of whatever nature fixed or fitted to the Property the removal of which would materially damage the fabric or decoration of the Property;
    (c) all items stated to be included in the sales particulars or advertisements made available to the Purchaser; and
    (d) the following insofar as any were in the Property when viewed by the Purchaser:
    garden shed or hut, greenhouse, summerhouse; all growing plants, shrubs, trees (except those in plant pots); all types of blinds, pelmets, curtain rails and runners, curtain poles and rings thereon; all carpets and floorcoverings (but excluding loose rugs), stair carpet fixings; fitted bedroom furniture; all bathroom and cloakroom
    mirrors, bathroom and toilet fittings; kitchen units; all cookers, hobs, ovens, washing machines, dishwashers, fridges and freezers if integral to or encased within matching units; extractor hoods, extractor tans, electric storage heaters, electric fires, electric
    light fittings (including all fluorescent lighting, external lighting, wall lights, dimmer switches and bulbs and bulb holders but not shades); television aerials and associated cables and sockets, satellite dishes; loft ladders; rotary clothes driers; burglar alarm, other security systems and associated equipment; secondary glazing;
    shelving, fireplace surround units, fire grates, fenders and associated ironmongery.

    The Seller warrants that at the Date of Settlement all items included in the Price are owned by the Seller, are or will be free of all debt, and are not the subject of any litigation.

    The Seller undertakes that the Property will be left in a clean and tidy condition at settlement"



    A standard offer can specify additional items to be included, as in;

    "The Price will include the following additional items (if any): "

    I'd counter with "take dishwasher but as kitchen is fitted please ensure the matching appliance door remains and is undamaged"

    If it is purely a standard washing machine under the worktop then buy new
