You mean like giving it a flying lesson? :rotfl:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Have you got an Android phone and if so, your TIMELINE in maps will prove the double dip.
And I disagree with colleagues on their kitchen sink advice. The "throw everything at them" approach is a great way for getting off with a technicality. We know it. POPLA knows it and can mask a genuine no dispute point such as you have. We have seen where a real point has been missed when it is immersed in a standard appeal. Obviously the adjudicator has thought " Oh no. Not another forum standard".
If you can prove it is a double dip, stick with that. If they were stupid enough to try court, your witness and other proof would cost them dear.0 -
Fantastic advice. Thank you so much.0

The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
,You never know how far you can go until you go too far.0 -
The SAR will prove the double dip.
You will have to give them approximate times of when you entered & left the car park
One you prove the double dip tell them that if they continue to process your personal information you will seek compo under DPA 2018
"If you continue to process my personal information other than to confirm that you have cancelled this PCN then I reserve the right to seek compensation under the Data Protection Act 2018 and complain to the Information Commissioner
The Court of Appeal in the case of Google vs Vidal Hall allowed compensation to be awarded for distress alone under the Data Protection Act. Google did not appeal the judgement to the Supreme Court"Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA
