Recent Upgrade to SIM only deal

Hi all
In December 2018 my phone contract with EE came to an end and a member of their store team called me to arrange an appointment. I advised him I didn't want to upgrade and didn't want to be locked into a contract, he advised a SIM only deal would be the best option. As this was just before Christmas i decided to leave it until the new year. So on 6th Jan I went through the "upgrade" process on their website to change to a SIM only deal.
My phone recently started playing up and would intermittently charge, anyway I decided to look for a new phone and found one on the same network through a 3rd party, I called EE on Saturday 26th to cancel my SIM only deal however I was told that I was in a 12 month contract and could only cancel if i paid a cancellation fee. This came as a surprise to me as I didn't see anywhere that there was a minimum term. The T&C's don't specify a minimum term.
I have since gone back through the upgrade process and the only reference to 12 months is "12 Month Plan" by the way if you go and look at SIM only deals as a new customer you there is a heading that states "All these plans last 12 months". Also the actual 30 day SIM's are not offered to existing customers through their website.
I feel the way the website is laid out and worded has misled me into a 12 month contract is there anything I can do? or am I just going to have to lump it?
PS no where during upgrade are you made aware there are two different SIM only deals and to call for the 30 day ones, however again as a new customer you are made aware by means of a big banner below the 12 month ones

Simply buy a new SIM-free handset to go with your 12 month SIM only plan, very likely cheaper than obtaining it with a new network contract.Evolution, not revolution0

What else do you think the terms "updgrade" (new contract) and "12 month plan" mean? In 12 months' time you'll know better.0

Just buy a SIM-free phone.
That's the way I've always done it, especially as I don't need the latest fancy gadget. I recently upgraded to a Xaoimi mi a2 lite and its plenty enough for me.0
