Got sent wrong item, they refuse to accept they're wrong - do I have rights?

Hi all,

I feel like I have been scammed and wanted to get some advice to check if anyone else has been in a similar situation and how they dealt with it...

I brought a wallet for a Xmas present for my dad from an online shop he saw advertised on Facebook called Wallets Guy.

He wanted the light brown colour which I ordered for him (and have e-mail proof of both the order and choice of colour).

When he opened the present (the first time I saw it too as it came in a black cardboard box that I just wrapped up) it was the yellow wallet, not the light brown one. When you go on the website to order you choose which colour you want and then there's a preview of the wallet colour. It's 100% the yellow one I got sent, not the light brown which I ordered.

I contacted them via email (no number on site and I think it's an American company) on Xmas day and it took them a week to reply (fair enough as it's Xmas holidays etc.). I have had about 3 or 4 emails back and forth taking pictures of the wallet, along with screenshots of the website clearly showing the previews of both the yellow and light brown wallet to support my case.

They are point blank refusing to accept that the colour wallet I have is yellow and they won't give me either my money back or send out the correct colour...

What are my options?

In my mind, haven't they broken a law by not delivering what I ordered? Is there a way to escalate this, or is it impossible with online companies like this based in the USA?

Hoping someone can give me some sage advice as I am getting quite worked up about it!

    Well buying off a facebook post is never a good idea but.


    If it is a real compnay with a real website (not facebook). You can ask for an exchange. They can ask you to send it back via trackable delivery (if you don't they will say it's lost so it is in your benefit). Will this cost more than it cost. Could well be.

    What law ??
    US law then it would be hard to enforce outside of USA without cost to you .
    As above re possible payment clawback .

    looks like the website was registered 6 months ago...less than 200 facebook followers...what could go wrong?

    Colour viewed on a computer screen is a very different thing from colour viewed in real life. Ever seen the photos in an estate agent's blurb and compared them to the real rooms?


    I have no idea what US laws are about right to return; I do know that US consumer law is rubbish in comparison to EU law so I wouldn't hold much hope.


    The good news is that you'll be able to buy a pretty much identical wallet in the colour you want from your nearest market trader for about £4.

    As the OP clearly stated that they checked on the website and there is a yellow option, I think it's probable that you've looked at the wrong ad.

    It could well be this one:

    It looks the same as the one you linked to but if you go to the Facebook page you can specify the country you are ordering from and for some reason the selection of colours available seems to change and a yellow one is shown if you pick UK.

    Paid for it using my credit card....I'm guessing there's no use of going to my credit saying I am scammed as I have technically received a wallet - if not the right one!

    Yep it's this one - I sent screenshots of both the yellow and light brown options from the website (which are so different) alongside the pic of what I received but they refuse to say it's not 'light brown' when it clearly is!
