Fight case? in Free EasyGym Parking ZZPS QDR

On 20/06/2018 I received a parking fine through the mail for going over the 1 hour parking limit at EasyGym, Kings Heath, Birmingham.
The issue is I was a member at the EasyGym which granted me a total of 2 hours free parking (of which I was in 2 hours) after entering my car registration within the gym but Its likely that I forgot to enter my registration on this occasion.
Instead of appealing the ticket within the 14 days you get with the £60 offer, I took the parking ticket to a member of staff of EasyGym within that 14 days and they said they would deal with it.
I thought this would get dealt with as this was the second time that this had happened in the year, the first I had also given to a member of staff and the gym manager got it cancelled (I have a letter that proves I've had one cancelled before with them) and this why I didn't bother to appeal.
Weeks later I receive a letter from a debt collector (ZZPS) that had taken the debt from the original collectors (Civil Enforcement LTD.) and me thinking I had dealt with it I assumed it was automatic so I ignored it. After receiving another letter from ZZPS I emailed EasyGym who told me that theres nothing they can do as the debt had been passed on already and they suggested that it's my fault for not appealing within the 14 days even though this only happened because I believed the staff were canceling the original fine.
I since moved back to university in October 2018 and have been stressed and busy with work that I haven't had time to deal them and hoping they would go away.
Recently coming back home for Christmas I received a letter from "QDPR Solicitors" on the 18th Jan 2019 who now have the debt and are demanding £180 within 14 days which as a student I cannot afford at all and do not want to be dealing with a court case should I not pay.
I am annoyed that EasyGym have been no help considering I would never have used the parking was it not for their PAID services I was using.

Is there anything I can do at this point or has it been left too long and I should just arrange some kind of payment plan? Thanks for any help.

    It is not a fine.

Edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people.

Do this before you do anything else.

Complain in writing or in person to the gym manager. Point out that other gyms are available and you can't afford to use this one due to the additional charges incurred by an unregulated scam operator. Sow the manager the comments in red from post 1 of the NEWBIES that our MPs have said in open parliament.

Send the blue appeal template from the NEWBIES adding that the gym have already instructed this invoice is to be cancelled. Do this from The Keeper.

Do not identify the driver at any point. It is quite possible that The Keeper is a gym member and was an Occupant of the car on the date of the alleged event.

    Complain to your MP.

So the parking event happened in June 2018 .... I think you're out of time for the blue template appeal to the PPC. Hang on in here for further clarification.

Meanwhile, absolutely do complain again to the Gym's manager. Make it a good one! Point out that threatening letters from debt collectors are now being received and that a member of staff at the gym gave an extremely misleading response which has now resulted in this worrying situation. I'd aim to make that one very well-constructed, assertive but nonetheless basically polite (not self-pitying) letters ever!

Also check out the Newbies' thread to find out more about the stage you're at, it is very possible to fight this once you get your head around it all. If you get a 'Letter Before Claim' then that's the time to get busy, but the Newbies' thread will explain more than I can.
  • Thanks for your advice I travelled to the gym and spoke with the manager. She said the original ticket should have been cancelled as instructed to the company and has since contacted the original issuer (Civil enforcement ltd.) which now 2 weeks later I have received a letter of cancellation from them.
I now need to contact QDR to confirm it is cancelled with them too as I received further letters from them days before receiving this one.

You mean you have a cancellation letter from CEL ???

CEL should advise QDR but no harm in telling QDR to shove it.

If QDR pester and harass you further, report them to the SRA

The power of the complaint to the contract principal.

    Hi guys

Exact same scenario as the original poster, except has progressed to a county court case. Driver is trying to compile line of defence but unsure what that would be. Dealing with ZZPS, C.E LTD and QDR solicitors. Driver has read through newbie defence templates but found nothing for this specific instance.

Any help ASAP as time is a factor.

    Many thanks

You really need to start your own thread for bespoke advice.

At the risk of sounding stupid how do I start a thread, there is no button for this on the board screen. I have registered and have sufficient clearance but don't have an option to start one, been trying for days.

Have you found the thread that tells Newbies to read it first? There are instructions and a big new thread button in it for people who struggle.

Yes there is. It is cunningly disguised by having New Thread written on it. :D
