Got a mobile speed camera fine ticket, can you please help!!!!

Hello everyone, I received a notice today for a police mobile van speeding fine. I was driving at 62 miles in a 50 mile zone and hands up I was speeding as I was going to the hospital to see my daughter who was admitted there from 18th January. The offence happened on a dual carriage Way on Sunday 20th jan at 9:40am and this is the first time in my entire life driving for 19 years that I got a speed camera or speeding ticket. The car is my wife’s car and I was driving it and She has got the notice today in her name stating to give details of the offence/driver in this case.

I have 2 questions to ask please. What will be the fine and points as I never had any in my life and I’m just plain worried, spoke to a colleague at work and he said you might get away with a speed awareness course.
2- Do I have a leg to stand on an appeal, stating that it’s my mistake but I was going to see my daughter in hospital after my wife’s call that she’s low on oxygen and she’s on oxygen mask and it made me panic. Would it help.

Thanks

Threshold is usually 10% plus 2mph which in your case is 57mph. You're over that.

In answer to 2, that appeal won't wash. If you wanted to plead it, you'd have to go to Court which would open yourself to a more severe penalty.

Just take the 3 points, £100 fine and learn from it.

The minimum penalty for speeding is a £100 fine and 3 penalty points added to your licence, you may also be offered a speed awareness course where you pay to attend the course and you dont get a fine or the points

you spend half a day being told about the dangers of speeding but keep a clean licence

in our police force area GoSafe say
Courses are available to drivers who respond quickly to the Notices and who were driving at no more than 10% +9 miles per hour above the posted speed limit. If there is a delay in identifying the driver, a course is unlikely to be offered.

so in a 50MPH zone you could be offered a speed awareness course if caught doing 64mph or less

rules for your police force may vary from that

IMO if you used that as an appeal wouldnt that mean you should have been driving slower because you were driving fast and also not paying attention as your mind was on your hospital visit.

if its your first offence and you dont get another in the next few years take the 3 points, the £100 fine and forget about it
  • Your wife MUST fill in that S172 and send it back (take the envelope into the posty and ask for a free reciept) ASAP delaying it could cost you any potential offers the force wants to offer, and if it reaches them outside 28days she will end up 6 points and fine and an MS90 which insurers hate and makes getting cover difficult.
You will be offered your own paperwork in due course.

Your under the prosecution guidlines, but i think your over the limit for a course, but not too sure (if you're not, one will be offered to you automatically by the force area ticketing office), try not to delay sending anything back as delaying could mean an offer of a course is not on the cards.

You can head over to Pepipoo website and get more detailed advice on this.

You presumably mean they are over the prosecution guidelines (i.e. could just get a FPN and 3 points/fine) but under the SC limit?

SA course is 10% + 9 as stated above (where operated and assuming they use this guideline). 62mph in a 50 is under the limit to get the SC course but is over the ACPO guideline for prosecution (10% + 2)

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

No, if he is OVER the prosecution limit of 76MPH then he wont get points but a court appearance, he is therefore UNDER the prosecution limit being at 62 Mph so will be offered points or a course IYSWIM.

The counter argument to that would be that you as a driver was responsible for recognising that panic made you unfit to drive, exceeding the speed limit by over 20% being proof of that. It is a non-starter.

Take what comes, whether the awareness course or the 3 points and £100 fine. You've had an unblemished record to date, this one off won't cause you any issues.

There is no point in going to court, even with an immediate guilty plea and mitigation the fine, costs and surcharge would be more than the fine you pay with an FPN.
