Minster Baywatch parking ticket

Hi all, just wondered if i could get some help/advice on a ticket my wife has just received from Minster Baywatch.
The ticket was sent to us on the 16th Jan referring back to 04/12/2018 as the 'contravention date'.
The car park is one of these Ringo jobs where you call to pay and park. She has been doing this since she started her new job last year. On the 4th of December she tried to call through 3 times around 9am when she parked but there was some kind of technical issue on the phone line and it wouldn't let her pay for the parking. She needed to get to work so left and then forgot about it as she went to work.
So basically the ticket has arrived now. We did appeal with Minster Baywatch showing them evidence that my wife parks and pays every day and she had tried 3 times on this particular day to pay (we sent them phone logs as proof of the calls). Obviously this was rejected and the scum bags want £100 for a £4.50 parking charge that didn't go through.
My wife is happy to defend herself but as i work in finance we need to avoid any kind of situation that could end with a CCJ. So the next option is to appeal to POPLA and i wondering about what you think our chances would be of successfully appealing this based on the above circumstances?
Thanks in advance.

It looks like you have given the scammers the driver's details, thus throwing your best appeal point of non PoFA complaint NTK down the drain. Unfortunately there is nothing that can be done about now.
Use all the appeal points available to you from post 3 of the NEWBIES and post your draft here before submitting it.
Take your own pics of the site and signage for this
What happened when you complained to the landowner? What sort of car park was this? Retail park, hospital, station etecetera?
Please complain to your MP about this unregulated scam.

but as i work in finance we need to avoid any kind of situation that could end with a CCJ.
If this is your wife's ticket, then the 'we need to avoid' doesn't compute with me. With you working in finance, you must surely know how a CCJ works? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Especially when you can pay on the day, and no CCJ ever happens. Its not rocket science, its all over this forum - which opefully you have researched, to save the few regulars from having to type the exact same info over and over and over and over and over....0

Thanks for your replies. yes i understand how a CCJ works and impacts your ability to obtain finance but i wouldn't want my wife having a CCJ either as she is a director of my ltd company.
Anyway this is what i was unclear about in terms of the process. So are you saying in a worse case scenario if they take my wife to court, if she loses then we can just pay the fine and no CCJ will be registered? They can only issue a CCJ if they win in court and we still don't pay is that right?0 -

Oh wait... clearly you don't. :rotfl:Anyway this is what i was unclear about in terms of the process. The answers to both your questions are - yes.
I hope your forum username isn't your car registration number?0 -

It is not a fine.
You can avoid a CCJ as long as you don't ignore anything, but why are you talking about failure at this stage?
Concentrate on your PoPLA appeal, which is not binding on the motorist, but is binding on the scammers.
Like I said, had you not revealed the driver's identity you would have won this easily at PoPLA, assuming ANPR was used. You are now looking for other appeal points to beat them with instead.
Please answer the other questions you have been asked. They are all designed to help you.I married my cousin. I had to...I don't have a sister.

Indeed, you dont understand how CCJs work!
They are a judgement from court
They are registered and exist the day after the hearing (usually)
If paid on the day NO CCJ is registered
If paid within one month (usual period) the registered CCJ is removed.
Yep, the same info...0 -
OK, so press ahead with POPLA. MB are nothing much to worry about.

Even when the driver has been given away in error, she could win on 'no landowner authority' so it's worth a shot using a couple of the template POPLA appeal points, in post #3 of the NEWBIES thread.
Certainly no paying them! No risk, no CCJ, nowt bad that affects you in any way.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
