UPDATE: "Claim from a Car Park Management firm"

So in November 2016 I first ventured on to this forum and posted about an issue I was aware of at a block of flats.
The thread was titled: "Claim from a Car Park Management firm"
Link: https://forums.moneysavingexpert.com/discussion/5563286/claim-from-a-car-park-management-firm
The thread is now closed and some of you might have noticed I haven't been around that much recently (due to dealing with this) so I thought to post an update on the outcome:
1) Management Company replaced
2) Car Park Management Company removed
There is some talk of some leaseholders investigating legal action, not sure how far that can go due to the experience level but if anyone wants to help/advise with that please do let me know and I can connect you.
In summary I can say that although a good result, it was extremely time consuming and it took a monumental effort to get people active on this subject and to apply pressure in the right areas. It's clear to me that this is an avenue of parking control that PPC's actively seek out. Equally, I feel Management Companies need to take a long hard look at themselves and the behavior they think they can get away with towards leaseholders and tenants, in this case it was, frankly, unacceptable.

well done , I certainly remember your username and your tenacity, so good to see you prevailed
we can only hope that the new PARKING CoP bill helps to sort it out in the future0 -
Well done safarmuk.
It might be a good idea to contact a Board Guide and ask them to open your old thread. Then ask them to merge the threads.0 -
It certainly is - and UKCPM (which I think was the parking company involved in your residential area) is the most prolific and most litigious. Well done on getting them booted out. It's clear to me that this is an avenue of parking control that PPC's actively seek out. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yep, on this subject it would be good to get hold of someone who can find out about discontinued cases over a set period of time in order to verify a few things. I seem to recall that would likely be people like IamEmanresu or Bargepole? If someone knows them and wouldn't mind asking them to get in touch that would be appreciated. It certainly is - and UKCPM (which I think was the parking company involved in your residential area) is the most prolific and most litigious. Well done on getting them booted out.
I am hoping I can be on here more in the future to continue to help out in this area, but still lots to do off forum keeping things in check so we will see.well done , I certainly remember your username and your tenacity, so good to see you prevailed
This I lost track of, definitely need to get up to speed again.we can only hope that the new PARKING CoP bill helps to sort it out in the future
Didn't know you could do this, will ask if I get a chance. It might be a good idea to contact a Board Guide and ask them to open your old thread. Then ask them to merge the threads.0 -

I think bargepole might be interested in that aspect, possibly. There is some talk of some leaseholders investigating legal action, not sure how far that can go due to the experience level but if anyone wants to help/advise with that please do let me know and I can connect you.
But I don't think anyone can find out discontinued cases unless they tried a FOI to the local court asking for how many discontinued cases occurred between xx date and xx date, where UKCPM were the claimant.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I don't know if it includes this but it would be a great boon if the time scale for county court was cut from 6 years to 6 months, like maggis court. If you don't know anything about it then there is no way yo can be prepared to fight them 6 years down the line. Its not the same as being sued by a builder for non payment, you would remember this. Please watch this ....

Careful what you wish for.peter_the_piper wrote: »I don't know if it includes this but it would be a great boon if the time scale for county court was cut from 6 years to 6 months, like maggis court.
In your scenario, would that mean that as long as a dodgy builder built a wall that lasted all of six months, there is no way to seek a remedy after that point?
Currently we can seek a remedy for up to six years.
But we seem to be drifting a bit off topic.

Let me know if he is or if LoC123 or Jonersh are. Just need to make an initial assessment of viability.I think bargepole might be interested in that aspect, possibly.
That is not a bad idea. But I don't think anyone can find out discontinued cases unless they tried a FOI to the local court asking for how many discontinued cases occurred between xx date and xx date, where UKCPM were the claimant.
There are also some other issues I am looking into that I need to investigate and maybe take up with the DVLA, waiting on info to proceed on those.0
