So may be too late for it.

I will still try and send via next day....

Failing that, i should still be able to read out the statements in court

You may not be even given the chance. Plenty of court reports where the defendant was not invited to speak.

Also an ambush in court is not allowed , but the CRA can be brought up

You can also include it in any reply if asked relevant questions

But as mentioned above , a judge may not even allow you to speak , if they have decided in your favour it may not get to your turn

Just got back,

adjourned....

my evidence was perfect emails of how they just havent updated the address.

I received no ws or evidence or anything.

The judge felt like there was ground for a claim and in order to serve justice to the claimant and be fair they have set it back 21 days. Judge seems to feel like the claim is there???

Judge asked me what I wanted and I said struck out.

claimant rep wanted it to be adjourned...
In his explanation at the beginning, it was simply I could have paid by app but i didnt have a smart phone.

So I simply shouldnt of parked there.

He used an example of if a shop doesnt take card and you only have cash... you dont just walk out the shop and take the items for free.

I had no room to explain as the first thing i did was say I have received nothing!

Bit of a nightmare as I just wanted it over. parking company will pay 2 hour worth of work lost for me... which they will pay in 21 days. ( thank god i took my payslip)

Just annoyed, as it wasnt the element of money, it was to do with getting my head cleared finally after a year of crap.

Id like to also thank everyone of you for your help too! as I would have had a chance otherwise.

Hearing looks like it will be early Feb now. Feel very demotivated.

Thats far too generous for a professionally rep'd company. They have NO excuses for ignoring a courts order.

Don't get downhearted. I felt like you when my case was rescheduled.

Where does it say in the contract that you should only visit the car park if you are in possession of a mobile phone? Where does it say in the contract that you should have moved your car? You were willing to pay but could not.

This company has form when it comes down to not maintaining their equipment.

Look at the Prendi decision which could have some influence. Also Link parking v Mr N.

Thank you very much Snakes Belly. I feel annoyed as I should have said more on why I think it should be struck out! as the legal rep went on and on using fancy words and a lot of detail.

im guessing my charge is now at around 230...

I didnt get a single chance to explain my side at all as I mentioned that I received nothing right away.

She held excels witness statement up in her hand. it look very chunky! so bloody demotivated...

Feel like I would have preferred bad news over just being left like this to sit on it for 2 months
