Britannia Rejected POPLA Appeal

Obviously you don't need this bit, for a 13 minute 'overstay/free car park' case:They merely state that vehicles must be parked correctly within their allocated parking bay, giving no definition of the term 'correctly parked', nor indicating which bays are allocated to whom.
Add a short section on BPA grace periods.
Add a section that says the letters before court, naming the 'creditor' were not from the Claimant (see avem1's thread for an important point).
What exact claimant name is on the N1 claim form?
What's the issued date of the N1 (top right)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Did Britannia include a copy of the landowner's agreement in their evidence to POPLA?
According to the POPLA agent's decision: "The operator has provided a valid contract which gives it the permissions to operate on the land in question."
I can't say that I remember seeing it, and dont have access to it now.0 -
Please be more precise.
Are the biggest letters on that so called 'letter' Claim Form?
What is the Issue Date on your Claim Form?
Meanwhile, do not carry out steps 1 and 2 on your 'next steps' list.
Apologies Keith, the letter is headed "Claim Form" and Issue Date is 13th May 2019.
I assume I need to get step number 1 done asap, due to the 14 day window to reply?
Thanks all for your help.0 -
With a Claim Issue Date of 13th May, you have until Monday 3rd June to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.Apologies Keith, the letter is headed "Claim Form" and Issue Date is 13th May 2019.

Having done the AoS, you have until 4pm on Monday 17th June 2019 to file your Defence.
That's four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Thank-you Keith. I had a look at post 2 on Newbies, and read a lot of advice.
In terms of my case, the signage is a joke - on the wrong side of the road, not pointing at the traffic, located on a tight right hand bend (where if you don't focus, you will certainly crash into a raised curb or another car). Then all the signs in the actual car park can be obscured by large cars. No signs by the shops. I intend to get many pictures and even a drive around video showing that they never come into direct field of vision.0 - Sign it and date it.

Thanks for this feedback, I will do some targetting searching on the forum and make these amendments.0 -

OK now read all the other Britannia threads from the past ten days or so...you need to look at the company numbers on all the letters.
Search the forum for Britannia company numberPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
