County Court Letter about unpaid Parking ticket which I am Unaware of

    Yes I have a claim form...
    Yes It is from County court business centre the issue date is 18 Jan 2019.
    With a Claim Issue Date of 18th January, you have until Wednesday 6th February to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

    Having done the AoS, you have until 4pm on Wednesday 20th February 2019 to file your Defence.

    That's over four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Is it a CLAIM FORM

    or is it an Order for judgment by default?

    Did you actually ignore a Claim form, in December?

    Please try to be as accurate as possible here as, if it gets to court, one wrong word could be costly. If you do not understand a question, seek clarification. Do you use a search engine, if not, you should.

    The whole industry is a scam, relying on threats of court, and public ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    Then read other defences, copy & adapt, and show us yours!
    I had just been confirmed from the Northern parking service that it is two PCN's for dates 15th APR 2016 and 16th APR 2016,
    How can they possibly have made the sum over NINE HUNDRED POUNDS? What a scam!

    Can you please type out the 'PARTICULARS OF CLAIM' from the left of the claim form, without your VRN?

  • Particulars Of Claim:
    1. The Claimant claims a debt in the sum of £640 for unpaid parking charges incurred by the Defendant for breaching the terms and conditions of parking on private land which is either owned or operated by the Claimant, together with debt recovery costs incurred.

    2. Despite several reminders and requests the Defendant has failed to pay the sums due.
    3. The claimant claims court fees and costs. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 16/04/2016 to 17/01/2019 on £640.00 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £0.14.

    How is this over £900 then, and surely above those words it must list the dates of the parking events, which cannot be just two?

    Sounds like 4 x £100 and they've scammingly added £60 to each one, to me.

    It's your court case at stake here.

    MSE's forumteam don't usually take that long.

    But it MUST be four PCNs, does it not list them? This is atrocious.

    They cannot make two PCNs over £600, then add another £300!

    Tell you what, show us the claim form, with your VRN and address and PASSWORD (bottom right) covered.

    Scan or photograph it and upload a readable image into Dropbox, then show us the 'share' URL link to the Dropbox image BUT CHANGE HTTP TO HXXP and add a gap or two, because you can't yet post working links.

    Please don't reply saying you can't post a link...
