Speeding fine refunded.

In August I went 49 at 10pm and 44 at 2am on a motor way there and back through the same speed camera. They had but a temporary speed limit of 40 in place.
I got the two speeding tickets through. The first I had to do a speed awareness course. Second was 3 points and £100. I paid for the course and the fine straight away but they said I had to hold off sending my licence because of the course. Bring stupid I went home put the letter and licence in an envelope and promptly forgot to send it. I got a reminder letter and sent it 1st class recorded. 2 weeks later I got a court summons and my licence back saying they didn't receive it in time and to plead on the summons. I plead guilty to the speeding but argued that it was sent with in the reminder time scale and the fine was paid straight away. This was at the beginning of December. Mid December I noticed the £100 had been refunded. Now I'm really worried. I've not heard anything since and it's not showing as me having any points. What is likely to happen now?

Andy is being his usual helpful self. Yes you will get a court summons now, but you should ask for the court to sentence at the fixed penalty level for clerical reasons unrelated to the offence. They nearly always oblige.

44 in a 40 would not normally be a prosecution, it would start at 46.

zLa. i think, although im not sure, that because its roadworks, they perhaps operate a zero tolerance to any speed above the limit. the 10% +2 is not law and they can prosecute at 1 mph over the limit.

They can but over at Pepipoo we have never seen a documented case of it happening, despite vague claims it has happened.

Ah yes Pepipoo who advise to ignore PPC notices which one person posting on another board on here did and ended up with a CCJ. Funny how those at Pepipoo have yet in a single case not been willing to stand by what they say to the point they'll pay the resulting court judgement made against people who follow their advice.

The question was what will happen next, so what was wrong with the answer? It's not like I claimed a parking ticket carries points.

Having been involved in the use of temporary motorway speed limits for over 15 years for a single film camera the start point was usually much higher than 10%+2. The advent of non-cabled wi-fi systems and average speed enforcement has meant that the starting point is 10%+2 but it can be higher.

Do you have links to the threads/case you are referring to?

I haven't seen Pepipoo advise ignoring PPC notices for years and have never seen them advise ignoring court papers or court orders so I am finding it very difficult to believe anyone "ended up with a CCJ" as a result of such advice.

I'm no fan of Pepipoo but I'm even less of a fan of fake news. In my opinion Pepipoo have some major issues and by all means berate them for any of the following but bad advice regarding CCJs is not something I've seen before.
    • One of the worst web site names in the history of the Internet
    • Hypocritical moderators who seem to have a god complex
    • Most Pepipoo posters spend more time point-scoring against other posters than actually helping out motorists with problems
Every generation blames the one before...

Then why was I given 3 points and a fine for doing 33 in a 30mph area?
It depends on the particular county.
