how did you pay, via paypal with your credit card, if your lucky you will have a good card company that will issue a chargeback against paypal, and then let paypal sort it out with the seller.
Listen to what people say, but watch what people what people do!!
  • Dave, when you open a dispute with ebay, they will keep the dispute open in your dispute console for 90 days. All this means is that they automatically close the dispute on the system.
Paypal give you 45 days to register a dispute, if your past this time then basically you've had it.
If you paid for your item with a credit card via paypal then you might have a chance of getting your money back.

That is correct. As soon as ebay identify that paypal has been used the claim is directed through them.

I know its also my fault for not knowing all the rules at e-bay etc but not many do.

I orderd the item in July as i hoped to get it for my holiday end august.

I contacted the seller straight after my hols and started dialouge with them to resolve.

Why didn't you contact before your hols, from that you waited at least 4 weeks to let seller know you hadn't received item. It is possible they had sent the item and believed you had received it, if someone waited that long to contact me about non-receipt I'd be suspicious.

It sounds like you've read the 45/90 day limits as when to do something rather than when to do it by.

If a buyer doesn't receive an item they usually contact the seller after between 5-10 days (depending on delivery details) to let them know.

At this stage it depends if you want to proceed, you could contact the seller again and politely ask them to help. It may not be the seller's fault that you never received the item, it may have been lost or stolen in transit or misdelivered.
    .
  • In the sellers feedback it was common for things to take up to a month.

I went away 3 weeks after the close date and was away for 3 weeks.

I was not to bothered it never arrived so i just contacted the seller and let them know i had not recieved it.

I just kept getting mails saying "please give me time to check with post office and I'll let you know"
Every few days I mailed to sak if any news and same old responce. When they did send a tracking number it didnt work.

As for the dispute I paid through paypal but was never directed to the paypal resolution center just the one withing e-bay.

Like I said the money is not an issue the goods are not an issue i just feel let down by e-bay for allowing me to stay within their system and by doing so lost my money.

As for the seller being suspicious all he had to do was prove delivery. I am not trying to rip anyone off and i have had no issues with e-bay before. The first time I need them to help me as one of the transactions had gone wrong I was let down.

still i have said good bye to the money and am not short of £25 to spend anymore time trying.

I still say e-bays rules let me and as such can let others down.

Did the tracking number end in GB? I bet it's just the reference from the certificate of posting - that won't track.

(Proper RD or SD tracking numbers end in GB)
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • The number started with RR and ended in CN.

Like i said thanks for any advise I suppose I needed to vent.

    job done and lesson learned.
