Ripped Off By E-bay

Well I bought somthing from e-bay and paid with their sister company paypal.
I didnt get the good and started a dispute. E-bays policy is to try to resolve the dispute between your selves as I did and they allow 90 days. So when it was getting close I decided to excalate the dispute as I was not getting anywhere with my purchace.

Their responce was hey sorry we will look in to it and by the way your now to late to get your money back from paypal too.

How convenient.

So after many mails trying to get someone to explain how can i be penilised for following procedures they are now just ignoring me and any attempt I make to contact them about the matter.

I have not been abusive at any point..

This mail is just a heads up.
THEY ALL SAY THERE IS PROTECTION BUT NOT IF YOU FOLLOW THE RULES it seems

    Paypal dispute period is 45 days...?

    Ebay dispute info:

    'Step 1: You open a dispute.
    You can open an item not received or significantly not as described dispute 10-60 days after the day on which the auction-style listing ended or you bought using Buy It Now (the "transaction date"). When you open a dispute, you indicate whether the item was not received or whether it was received but significantly not as described. Items that become faulty after you receive them are not considered "significantly not as described". You should contact the seller directly to work out a solution if an item you purchase develops a fault.

    As you paid with paypal you need to follow paypal's policy (45) - but I don't know where you got 90 days from.

    You can open it and the dispute is allowed to run for 90 days...

    believe me on this I WENT THROUGH IT

    sorry but if you are not open to question you wont get any warm response here
    afaik fay does not work for ebay.
    you paid via paypal and didnt follow the rules associated with it in respect of lodging a claim.

    if you had sought out the forum sooner you could have got practical help rather than your self proposed mission

    your first act should have been to contact the seller
    and a lot sooner than you did.

    Mostly the sellers on ebay are a
    pretty honest bunch,not really had any
    problems with anything I have ever bought
    and as a seller the odd time something does not arrive
    I take it up with Royal Mail try and find out whats
    happened to it and inevitably it turns up
    the odd time when its well and truly lost
    I put in for a refund.

    I always post out everything on recorded post
    or special delivery paid for by the bidders

    I always pay the extra myself for the
    things I buy,an extra 70p is a small price to pay for
    peace of mind and it makes it easier to find parcels
    in the system.

    Just because you feel you have had one rotten
    experience you cant condemn the whole site
    When really you never went about the proccess
    in the best way.

  • there was no question just a stement about where i got 90 days from. I have just got from writing a long mail to ebay and wrote the reply in that mind set. I basically followed e-bays rules and because i did and tried to resolve it with the seller through the dispute console thatmade it that i was out of time to claim back my money. I got no warning from anyone that time was running out to get a refund and was allowed to carry on within the dispute console. Yes hindsight is a good thing but following e-bay rules cost me and thats not what i call protection.

    First thing up mate....few people on this forum are more helpful than Fay......you took her statement the wrong way entirely, she was trying to sort out what had been said and to give you scope to reply so I think you owe her an apology...and NO I don't work for eBay and I only know Fay's name from her posts on this forum...which are always set to help people.

    How long after the purchase date did you contact Paypal / eBay?
    Did you chase the seller and if so, did they give you any info on when/ how the item you bought was purchased?
    Did you keep the e-mail correspendence from your seller?

    If you can give the forum this info....let's see what we can/ can't do.

  • Mike I appologised to her personally through pm 15 minutes ago.

    I have calmed down somewhat after my long mail to e-bay.

    As I said to her I'm not normally a hot head but as were all here to save money I do get a bit peeved when i feel i have been taken on a ride.

    I know its also my fault for not knowing all the rules at e-bay etc but not many do.

    I orderd the item in July as i hoped to get it for my holiday end august.

    I contacted the seller straight after my hols and started dialouge with them to resolve. When it became close to the end date of being able to open a dispute I warned the seller i had no option if it wasnt resolved i would have to open a dispute.

    I did and the same old dialouge continued but within the e-bay dispute console. They say you must try your best to resolve mutually and i was paitient to the hilt but the time came to pass it on to e-bay before the dispute timed out. Now the fact i was within the e-bay rules and timeframe I PRESSUMED (bad thing to do) that when i passed it on that it would automatically allow me to then reclaim my money but it had passed the time for paypal. Being the same group of companies I was a little miffed at that and the fact i had not been warned. My mails have been nothing more than to try to understand how this can happen withing the rules. I lost out.
