All PPCs have a privacy page and I Googled & found this in seconds, and it has a DPO email addy:So I've received a Letter Before Claim through the post from our friends at Vehicle Control Services Ltd asking for £160 and estimated court fees of £20. I've been through the Newbie thread and seen that the first step is to send an email requesting SAR via their contact form - is this correct? They don't seem to have a privacy page or contact, just a general contact form.

URGENT you MUST edit your first post to talk about the driver in the third person! PPCs read this forum and the driver should NEVER be implied:THE DRIVER parked in a car park to visit an establishment, that I've been to many times, and you write your number plate down when you enter WHICH THE DRIVER DID... and have done previously with no trouble.
No.Do I need to send a letter through the post as well as through the contact form? I don't want to risk missing any deadlines.
Yes. The NEWBIES thread is up to date, edited regularly by me.Is this the correct template for the SAR?

Thank you for the reply! The post had been edited...!
Foolishly I also realise I should have simply Googled it, thanks for doing that. I'm trying to digest all the valuable info on here so wasn't thinking straight.
I'll start work on the SAR now and keep the thread updated.0 -
The SAR has gone in via email.
Just out of curiosity is the next step to sit back and wait now for the next letter?
I'm unable to contact the retailer to complain as they no longer exist. Do I need to contact the landowner to complain or does the PPC contact them in relation to the SAR?
I don't quite understand what the SAR will achieve.0 -
The PPC will not do anything to help you, only themselves, so you need to find out the landowner and contact/complain to themI'm unable to contact the retailer to complain as they no longer exist. Do I need to contact the landowner to complain or does the PPC contact them in relation to the SAR?
The SAR will force the PPC to give you all the data they hold on you so that you are better informed and able to refute/rebut/defend their claims.I don't quite understand what the SAR will achieve.0 -
Thanks for the reply, is there a template of sorts for the landowner complaint letter?0
-
No template for it because every one would be different. You could try searching the forum using Advanced search with landowner complaint as your search term and changing the radio button from Threads to Posts.0

IMO these claims seeking damages for incorrect VRN entry are frivolous, vexatious, and a waste of court time. Judges should start punishing these claimants.

I doubt if any judge would seriously consider them to be genuine breaches of contract, especially if the key pad is unfamiliar to the motorist. You never know how far you can go until you go too far.0 -
Hi again, just a quick question I've sent off the SAR via email (nothing back yet), do I also have to respond to the LBC that was sent? (The LBC is from VSC not a solicitors)
I'm in contact with the land owner but that is going nowhere fast so don't expect much from it, I'm following the advice in post #2 of the newbies thread and that says to send in the SAR, and then DO RESPOND, but then it goes back to more SAR info so not sure exactly what the next step is. I've seen thread that say that it's necessary to respond to the LBC so just after some advice on what to do now?
Thanks.0 -
If the LBC gave you 30 days to respond and came with a full set of Particulars of Claim (or said POC to follow) you must respond within the time scale set. You should refute all/any of the claims made in the POC. You will/may then receive court papers.0

The LBC basically states that they have given 30 days to repay the debt owing.
'We are contacting you in relation to an outstanding liability (debt). This matter had now been passed to our legal department in order to recover the sum of £xxx in respect of an outstanding charge notice for breaching the terms and conditions relating to the use of private land.'
Then they go on to say 'The sum of specified above includes debt collection charge of £60, as previously notified. Despite out best endeavours to recover payment it has proven unsuccessful, and as such, we have no alternative but to commence legal proceedings. Should the the outstanding balance not be settled by (feb) we will commence legal proceedings against you without further notice.'
Also included was:
Annex 1 - Information Sheet and Reply Form
Annex 2 - Financial Statement
After the 30 days they state they will commence legal proceedings.
There isn't a great detail on what to do next apart from, they say, to pay the fine.0
