    my thoughts were that it had been sent to BRIT and not to the DPO at BRIT, so had not gone to their DPA department, and so a minion in C/S/ replied with a stock response to a request about the outstanding charge, instead of it being treated as an SAR , hence why I asked for the content and email address used

    ie:- the SAR should have been emailed to the DPO at BRIT

    and thats it, not post , not to their general email addy, but direct to their DPO

    There have been many cases of late where OPs are asking in their SAR for stuff they should be seeking only via the PaP, like copies of landowner contracts, maps of car park, photos of signage etc. There seems to be a misunderstanding that the SAR is the equivalent of a FOI enquiry of a public body, where almost anything can be asked.

    With the current carry on with Britannia, do they actually have a DPO, I doubt it. I do think they are following a misconceived idea from a third party which is very foolish

    Please could you let me know if this was ok and I can proceed with complaint to ICO or whether I need to change and resend? Britannia didn’t acknowledge the request at all and said in regards to the correspondence please contact bw legal

    •​Any and all Documents mentioning my name or any details relating to myself i.e. vehicle registration/contact details/ PCN number etc

    •​Full email history and the emails mentioning PCN number, myself or vehicle registration/contact details etc
    •​All interaction made with any other private company where data regarding my PCN number/vehicle/details have been discussed.
    •​A list of all telephone calls made where my PCN or details are mentioned and details of what was said.
    •​Of Particular interest is any documentation trail showing how and who has sold/passed my details relevant to the PCN or personal details.
    •​Copies of all documents/email/ or communication by any other means
    •​Full disclosure of all information held about myself, my details and or my vehicle
    •​Details relating to what information is viewable by any external companies handling mail on your behalf, i.e. are envelopes sealed prior to being issued to mail handling companies used if applicable.
    •​I request a full itinerary of what happens and what stages my data is processed under whilst in your database
    •​Proof of the rights you have to manage my data

    It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month and that under new GDPR Data Protection Act 2018 no fee is payable.

    Out of interest what was their reply to that request? That looks like a compliant SAR to me. You are only asking for data pertaining to yourself.

    That's a very good SAR Mazzamonkey, I was rather expecting the type I've alluded to earlier in the thread. I can see why they've refused to deal with it - it's too difficult for them. Rather tough that is for them!

    I'd send it again, with a covering letter reminding them of their legal obligation to respond fully with all information they hold on you and your vehicle. As they've failed to reply fully previously, you are now giving them a final 7 days in which to put together a full and detailed response, otherwise you will be reporting this serious disregarding of the GDPR of the DPA to the ICO.

    This time, no signed for post, just use first class post and get a Certificate of Posting from your PO counter. Keep that Certificate safe as you may need to show it to the ICO if the PPC denies receipt. Having the certificate will confirm that the letter was received by the second working day after posting.

    I would also send a copy of that to the BPA, along with the reply they gave, and ask them to remind their members of their legal obligations.

    Inform the BPA if no answer is forthcoming a report to the ICO will be made. The BPA may well want to protect their members interest.

    It sounds like they didn't even read it. A complaint to the BPA might oil the wheels a bit.
