    You should've raised the issue of your costs with the Judge after the Judgment had been made - whilst still in the court.
    Is an adjournment a judgment? I presumed we'd be coming back to the court room :(

    Ah sorry, I hadn't realised that your case was adjourned then the Claimant discontinued.

    Has the adjourned hearing date been confirmed? If so ask the court to turn it into a costs hearing rather than vacating it.
  • This ain’t coming back. The NOD filed by the claimant means that’s return date won’t ever be listed. It’s done.

    Nothing to stop you trying to get costs on the basis that C terminated the claim having heard submissions and without permitting your costs of attending to be summarily assessed, but I doubt it’ll be listed for a hearing. If the DJ said YOU were unreasonable then enhanced costs seem unlikely in any event.

    Ha, I had thought this too - I think I'll just let this one go. Realistically I was never expecting any money back, and was more interested in just 'winning' and not paying the sum they were after.

    For anyone reading this wondering why the NOD was filed, I think it was the fact the claimant had failed to follow POFA correctly is what shut it down.
