Disabled Bay Colour

Does anyone know what the colour of a disabled parking bay should be? I always thought they were bright yellow and clearly visible. I inadvertently parked at night in a private car park managed by EXCEL PARKING who are an an Accredited Operator and a member of IPC. I didn't notice the washed out blue disabled parking bay in the dark and received a £60 parking fine. The initial notice stuck on my car read "Attention Document Enclosed. This is not a Parking Charge Notice'. This was followed up with a letter which contained the actual Parking Charge Notice. I have appealed to EXCEL PARKING on the grounds that their disabled bays were not clearly marked and therefore not visible but this appeal has been turned down. I now have to appeal to the IAS. Does anyone have any advice on this matter?

    A - If it's PCM then give it a go as they seem to enter 'no contests' sometimes, but otherwise, no chance unless you have something ground-shattering like proof there are NO signs up, or if they've said you were the driver/keeper and you are neither (e.g. if you are a non-driving resident and appealed instead of a family member keeper/driver, then it can be fun to expose the PPC to that fact at IAS, proving you can't drive!). Normal appeal facts like 'I was not the driver, no keeper liability' don't cut it with the IAS which is deemed to be a kangaroo court, and losing that stage will make most posters feel worse, and more worried. SO DON'T!
    This advice is from the NEWBIE sticky that you will find on page one of the parking forum, third post down, I suggest you read it to be better informed.

    They can be sky blue with pink spots if they so desire these are private parking invoices given out like confetti in an unregulated scam industry.


    Of course they turned the appeal down there's no money in upholding it.


    Though if it did get to court your evidence of bad signage and markings might persuade a clued up judge they had trapped you.


    But it's all in the newbies thread, we don't advise paying scammers, and the next step will be more confetti from useless debt collectors also in on the scam.

    It is the will of Parliament that these scammers be put out of business.

    Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    You should go back and get photos of the signs including the bay markings. Take the pics in the same light conditions without flash as seen from the driver's position.

    I suggest you park elsewhere and go on foot to do this.

    depends if you can persuade a judge in court about your argument in post #1 of this thread

    we dont give advice on payment versus non-payment , that is a matter for you, but its not a "fine" , its an invoice demanding payment, same as the sc@mmers from Nigeria or elsewhere send out, but perhaps with a little more creedence and might be upheld in an english court of law

    I agree with your opening post,the bays should be marked so its obvious to ray charles that this is a disabled bay, it wasnt, so persuade a judge by getting pictures etc and you may win the day

    nothing will change until the new parking bill becomes law

    We hardly ever tell people to pay the charge. Ultimately it is your decision and whether you want to lie down and be rolled over.

    Before you do actually get your money out, why not get some photos (as per Fruitcake's advice) for us to have a look at?

    But you have to have a decent argument to beat them if they do court. I have rarely seen a coloured disabled bay either private or public so you need more than that to win,
