Take the whole procedure carefully and if there is a court nearby, try to get some advice from them.
It might be sensible to start by claiming one salary payment so that you can get a second bite at the cherry if the first claim fails.
Set out your bank statements and practise your explanation on several people before giving it to the court - you are effectively claiming that the professional bankers have been incompetent, so your explanations need to be particularly clear (bank statements marked in colours etc.) .
Is there some reason that the HSBC loan should not have been passed to you ?0 -
I also asked OP the same question, what was the reason given for the loan while applying in HSBC.brianposter wrote: »Use the small claims court https://www.gov.uk/make-court-claim-for-money

Sounds like a terrible experience and I fully sympathise with the fact that the process is (partly by necessity) frustratingly secretive and with all timescales existing as nebulous guidelines.
Still, a few things don't add up, first and foremost what reasons were given for not releasing your salary? Accounts under review are frozen except, as you say, for verifiable credits required for day to day living such as salary, pension or benefits. All that is required to release these funds is sight of a corroborating document (in your case, a payslip) and furthermore this is a process which is done at branch level. It doens't require specialist authorisation. So, what reasons were cited for denying you months of salary?: )0 -
The reason on the loan documents shows as follows:
Unexpected costs
Other: Buying a car, holiday and general costs
In relation to my salary being heald at the time all I was told was that there was notes on the file which stated the documentation had to be sent off for review and it wasn't able to be done at branch staff level.
This whole process has been a complete mess since the start0 -
OP,
I completely sympathize with you. IMHO Barclays are probably the most over zealous bank when it comes to blocking/freezing accounts...it seems their fraud detection systems are super paranoid. You then have to call their New Delhi/Mumbai based fraud team which means waiting 40+ mins on the phone. Only for them to tell you "sorry, computer says no"
I opened an account with them a couple of years ago, 2 weeks later £3k went in from my employer at the end of the month (monthly salary) and boom! a day later they froze the account. However luckily/bizarrely their iOS app continued to work and I managed to transfer the £3k into my FirstDirect account without any issues....despite being locked out of their regular internet banking. Thankfully they didn't leave any Cifas marker on my credit report but I certainly won't be going anywhere near them again. The reason for opening an account? I wanted their custom design debit card...sad I know :rotfl:
Once this is resolved, I suggest you open an account with a decent bank/BS such as Nationwide or First Direct. They are both very good and a world away from Barclays wrt customer support. Hope you get this resolved soon, good luck!! :T0 -
Update:
Spoke to CIFA who told me since it's first party fraud they would not and could not do anything, will have to go through Financial Ombudsment Service or Courts to get this resolved.
Barclays have 3 weeks left to respond, out of interest one of my main questions I had was what is it I could actually look to achieve here, if and when Barclays get found to have acted unjustly against me or negligently or whatever the term is, what can I push for against them as this has screwed everything up for me and I would like to see them heald accountable and some action taken.0 -
OP could we have a breakdown of events eg start in June 2017 with the loan being taken out.0
