Britannia Parking/BW Legal

Good morning,

Im after a bit of advice please...i have emailed Britannia parking for a SAR and emailed BW Legal requesting my case be put on hold but they both havent responded to my email. Bw legal have threatened court action if i dont respond by the 23rd Jan. Its regarding a non payment of a parking ticket from brittania which i am disputing due to unclear signage.

    BRIT have 30 days to reply to the SAR, as long as it was emailed to their DPO ?


    so when were the 2 initial emails made ?


    at the moment you are waiting for that reply plus the next steps by B W LEGAL, its a game of ping pong

    if its been longer than 30 days, email that DPO again and complain about the delay, copy yourself into the address so you also get a copy and proof of delivery

    IGNORANCE is the order of the day by these two.

    Before BWLegal can commence court action, they must send you a letter before claim

    The letter must prove their claim, the costs and give you 30 days to respond/rebut

    Assume BWLegal has added their fake scam charge of £60

    Get to grips with this lot and how they lose

  • Thank you for the replies...i received the letter before claim before Christmas and sent them an email on the 9th Jan. I think i may have left it a bit late! Yes added the £60 on too. It was a genuine error on my part as i did not see the signs and didnt expect them at a retail park. I bought a sofa for £450. I sent the sar to the dpo.

    I was annoyed with bw as they somehow got my personal email address and mobile phone number and were constantly leaving voicemails until i blocked them.

    Guess i will have to fight in court now

    So now - pick apart the SAR response and start to compose your defence....
    No point getting frustrated at the fact that they have your details - you would have had to give them anyway.
    If you choose to fight, then follow the templates and stickies in the threads at the beginning of this forum

    If you were told to respond by 23rd Jan and did so by 9th....you are still in date...no?

    Have you complained to the landowner / retail outlet / MP as per the advice given to others? [I am new to this but went through this process and was successful on the detail provided in my SAR ... but the principle remains the same].

    You will need to be forensic in your knowledge of the detail eg. how to appeal the £60 etc but there are templates to assist....better to put the work in now before the clock starts ticking down and the pressure mounts up before a court appearance!

    What did the Furniture Store Manager do to cancel it when you complained?

    Never too late. Be quick, get it cancelled by kicking up a stink with the retail park.

    YOU’RE REQUEST FOR ADDITIONAL INFORMATION

    Landowner agreement - You are not entitled to business sensitive information, it will only be supplied at court, as evidence and not before.
    Contract with the driver - The contract is on the signage in the car park. A copy of the signage will be provided as evidence at court.
    Machine reports - You are not entitled to transactions which do not relate to you, you will be provided with your transaction only. We are under no obligation to provide you with anything further.
    Picture packs - A copy of the signage will be provided as evidence at court.

    Whats peoples thoughts on the best way to maybe pay without having to pay the additional charges...ie the 60 quid bw legal have added.

    Im in the military and away a lot so im thinking i might just suck it up and pay

  • You seem to have missed the numerous recommendations above to complain to the management of the furniture shop you bought a sofa from. If they have contracted the PPC themselves, they can cancel a PCN at any point up to a live court claim being issued.

    If they aren't the landowner demand to know the contact details of the actual landowner/management agent for the land (there might even be signage stating "land owned by......" "this property managed by......."). A well written complaint with proof of custom, and an outline of your personal circumstances (in the armed forces and thus away a lot) really can resolve this issue. I complained after receiving an LBC from BWLegal on behalf of Britannia and got a cancellation within a couple of weeks form the management agent. So it can be done late in the process.

    I would honestly recommend you try to get a landowner cancellation as the posters above have advised..
  • Ok thank you...i will try and contact the land owner...i actually contacted scs previously and got the below reply...

    I am sorry to hear you received a parking penalty whilst shopping at our West Quay branch.

    Unfortunately the car parking fees and penalties are not under any control of Scs as a company .

    The car parking charges are clearly advertised by various machines within the retail park one of which is right outside our own doors

    Scs as a company have no ability to affect the parking notice you have received please refer back to the penalty issuer .

    Dear SCS

    Thank you for your very unhelpful letter in which you clearly have no intention of trying to help one of your customers who is shortly to be taken to court by the parking company, not only penalising your customers, but no doubt affecting footfall on the xxxxxRerail Park as more and more motorists are avoiding such areas carrying a risk of a parking penalty by shopping online. Our 'crime' was - shopping in your store!

    I presume you pay rent/lease to operate on xxxxx Retail Park, so you know who is, and have likely access to the landholder and/or their managing agent (MA). You could so easily make contact, given the growing threat to your business, and get this ticket for a real and genuine customer cancelled by the MA. Clearly you seem to have no interest in doing so.

    Please remind me what your return of unwanted goods policy is. (If you're within the return period and can do without your sofa until you find a replacement! :D).
