My top TWO tips for anybody new to this is

    1) Request a SAR (Subject Access Request) in all circumstances- it helped me enormously as the VCS numpty took a photograph of the building work in my allocated spaces which strengthened my defence. Thanks VCS numpty!

    2) Put pressure, pressure and more pressure on the supermarket/managing agency/the people who employed the cowboys in the first place............... if one person at the company doesn't respond- find somebody else who might, you are the customer.......... I was e-mailing the management company on a daily basis towards the end and copied in the Chief Executive, the Regional Manager and probably the cleaner..............!!!!

Tell everyone how bad they are and how they can be beaten.

At the court office I mentioned VCS and the lady said 'we get an awful lot of complaints about them'.
  • :TLove the fact you got all their contracts cancelled. Mr SRS is going to have to buy a smaller boat.

I have noticed in Excel/VCS company returns his gross profit is down, and his directors cut is also down.:)

Fantastic news Jester!!! Hopefully the new regulations coming through Parliament will decrease his profits even more. No wonder they are digging up old claims from 2015- looks like desperate times!!!

Response from my MP- I just wanted to raise awareness and ask him to support the legislation going through parliament.

'Many thanks for your email to the office of XXXXXXXXXXXXXXX regarding your experience with VCS. We have had a number of emails regarding what is considered to be unfair practices from VCS. VCS and other private car parking companies are notoriously hard to negotiate with and unfortunately XXXXX has no jurisdiction over them. We have attempted on a few occasions to challenge PCNs but mostly without any success.

We keep a log of all of our communication with VCS and challenge the cases as and when we are contacted. Thank you for raising your experience with XXXX's office it's helpful to build up a picture of their practices overall.'

    Kind Regards

That sounds like a fob off response before they file your complaint, but hey - kudos to you - this was a RESULT!
the landowner also told me that they have cancelled ALL contracts they had with VCS across the north of England, which includes about a dozen sites- one alone rakes in £30,000 a year in fines! So for the sake of a hundred quid or so VCS look set to lose tens of thousands!!!

So I didn't get my hearing (which I was confident of winning) and therefore it will be difficult to claim costs....

On the contrary, I would say that it would make it easier.

I understand that many judges consider playing fast and loose with the court process is unreasonable behaviour, The opens the way for you to claim unreasonable behaviour costs under CPR27.14(2)(g). Your can claim £19 an hour for your time, (including attending Court), or perhaps even more if you are self employed, travel, stationery, postage etc.).

I the judge rejects the claim, (or reduces it), you can make a claim against the scammer.

I am rather surprise at your MP's reply He seems unaware that parliemnt has passed a bill regulating these scammers.

Thanks, it is worth a letter to the judge, I will do one this weekend. Do you think the fact the management company paid on my behalf (maybe admitting liability??) will effect my claims for costs?

They just wanted to get rid of the claim and cancel VCS contracts to literally get rid of them from their sites

Thanks for all the hard work and time you and all the others into this forum Coupon Mad. You have saved people thousands of pounds.

And I genuinely do believe the management company have cancelled contracts with VCS. They were appalled at how their operatives behaved across numerous sites, and the lack of response from VCS on many occasions. Quite simply they were effecting business so had to act.

They told me on the phone and in writing on numerous occasions that this is what they would be doing.

    Couldn’t happen to a nicer company 😂😂:j

Sorry, I do not know what the judge will decide. Why don't you join us as a regular? Learning the ropes is not rocket science, and I think that you really could do some damage.

Yes I am going to hang around, even just to remind people to complete SAR requests and pester their restaurant/shop/management agent.

I also have experience of going to court twice for this parking lark and can assure people the people representing these cowboys are nothing to be scared of 🤙🏻🤙🏻
