PCN after buying wrong ticket

Hi all
I have looked at the NEWBIES thread but I think my case is a bit different hence asking for help.
Got a PCN from ParkingEye via my car leasing company, with a pay-by date of 18th Jan.
I thought I was paying for parking in Pangbourne Working Mens Club (run by ParkingEye). through the Pay By Phone website. Turns out I paid for parking in the next-door Pangbourne River Meadow car park, which is council-owned.
It would appear you can pay for parking for both car parks through Pay By Phone, and I've managed to pick the wrong car park.
I don't live there so can't check signage etc but I've clearly tried to pay for parking and just made a mistake. I have a print out of the parking that I did pay for (!).
Do I have any chance/grounds for appeal? I know not to bother paying early for a 'discount' and about not giving driver details.
Cheers all

We’ve just received a similar letter. We parked beneath the sign giving details of the number of the parking site and entered those into the parking app and paid. We returned within an hour.
Could it be the parking company’s system is at fault?0 -
Actually it gets worse! Just been to the car park. If you use the app and ask it to find your location, it provides the number of the neighbouring West Berkshire Council Riverside car park! This is how we entered our location when we were given a fine!
I think both the Working Men’s Club and the council need to be informed about it.0 -
TO THE OP
see the edna basher advice in the NEWBIES thread (the bottom of post #1 of that thread) about appealing a lease vehicle, paying particular attention to the POFA requirements like hire docs
appeal as KEEPER (lessee/hirer) on the PE website
no blabbing about who was driving1 -
Thanks both. If I recall I used location services, and as the option that came up was 'Pangbourne' I assumed it was the right car park. Sounds like there's a fault. Are there any precedents of grounds to appeal an faulty website / app on? There must be a template wording for that...
I'll have a look at Edna's template too re. lease cars.0 -
I am not sure that any private parking contract has caveats about payment by app, or by cash , or whatever (its an unregulated industry, and laws rarely catch up with technology)
I suspect that each case would stand or fall on its own merits , with a judge presiding
pay-by-phone is probably a sub contractor , so you may have an issue with them
mitigation doesnt win appeals, legal arguments do, like frustration of contract etc0 -

No different from any other (winnable) lease/hire car case.
As per the NEWBIES thread, do not start writing about who paid/who the driver was/what the signs were like, and only appeal when YOU shortly receive PE's NTH in your name, not to the PCN issued to the lease firm...
...unless you mean you already received your own PCN, in which case use the hirer version appeal by Edna Basher now, online.
There is a method to winning in hire cases and it is not about the story of what happened, and certainly NOT blabbing about who the driver was. We’ve just received a similar letter. Could it be the parking company’s system is at fault?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
Sorry for dragging up an old thread but how did this work out in the end? I've done exactly the same thing in the same location so am wondering whether to challenge it or not.
Thanks,

This won’t make me popular on here but I gave up after Parking Eye refused my appeal. Family circumstances meant it just wasn’t worth my time pursuing - I had too many other more important things to concentrate on so just paid the fine and vowed never to return to Pangbourne...good luck though.0

It was never a fine. There is a good pub in Pangbourne, on the river with free parking. nYou never know how far you can go until you go too far.1
