Any advice for this newbie PLEASE

I recently parked in a parking area of 4 shops one of which was nandos. I parked in the disabled bay and used my blue badges i then went to the majestic wine shop for less than 10 min. A couple wks later my fiancee got a letter from national parking enforcment asking if she was the driver of a range rover
So i sent an email to say that although her name is on log book i am the owner & driver. I then explained how i was legally parked with my badges etc
They came back with as i did not go to nandos ( had a camera up a post) i was liable for a £100 fine. Pay now & its reduced to £60. I decided to appeal to ias and finally they came back that i had lost the appeal. That was on dec 21 & we was leaving the country on dec 23. Also altho i spelt my name correct when i filled forms out they sent it back wirth the spelling of my first name as ler instead of lee. Not sure how legal that makes it. But now NPE want £100. I have re sent emails stating i am entiled to appeal but they say its in there t&cs if i appeal i have to pay the full cost. Now they say if i do not pay i will get bailifs etc. Now i have no fear of these as i spent 25 yrs on the doors of many clubs etc and can handle myself i also have no car or home in my name as i used to be bankrupt. Its over now and my credit score is back up. What i want is to get to court and speak before a proper judge to see what they say. However any help or advice on here would be very much apriciated as i do not want to pay these robbing theives anything. At least !!!! turpin had the grace to wear a mask when he robbed people. These tho are faceless crooks

At the top of this board is a thread that tells Newbies to read it first. It is a comprehensive guide to fighting tickets.
Sadly you appealed to the IAS. We recommend not bothering as an appeal to them is usually futile. A rejection seems to scare people into wanting to pay.
You are now at the debt collectors stage. They will bombard you with scary letters threatening all sorts. They are actually powerless to do anything other than send scary letters.
You might get a letter before claim. This will contain financial information forms. Debt collectors letters won't contain any forms. You need to respond to a letter before claim if you get one as it is a genuine warning they may take you to court. Come back for further advice if you get one.

Thank you for the reply i have read lots on here but to be honest its a bit a minefield finding my way around the site. I had hoped to hear the words “ just ignore them they cant do nothing” but i guess im wrong. Should i just swallow my pride and pay the outragious £100 before it gets any higher? no matter how big n strong any of us are. Letters through door are still a concern and cause stress etc. There is always the concern if it did go to court and loose the costs would be much higher.0 -
Why on earth would you pay this slimy scummy company £100 for "not going in Nandos?
They can't just "send bailiffs around" and it's not a fine.
Were there signs to say you had to go in Nandos, or the disabled spaces were reserved for Nandos?
Most of what is on the newbies thread has passed passed for you now and you are in a waiting game where you will receive silly debt collectors letters.
I would wait and see what happens but it's your choice if you want to pay a cobbled together scam.
At the last check this scummy firm don't like court anyway as far as I'm aware.0 -
They're scamming you so why pay them? They cannot send bailiffs to you either.
Use a laptop/PC to browse this website. Makes the navigation much easier. Then do your research, starting with the stickied NEWBIES thread in this forum. Also, incorporate paragraphs into your comments to make them more legible.0 -
If this were to go to court they would have to prove, along with a multitude of other things, that you did not go to Nando. I wonder how they would do that. Is CCTV evidence admissible in the Civil Courts, or would that be an invasion of privacy?
Complain to your MP as it is the will of Parliament that these scammers be put out of business.
Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

It transpired that there was signs but the 4 bays next to the disabled bay i parked in the signs are larger and clearly say “ for nandos customers only”. The disabled bay has a sign with loads of smaller wording, about the site etc and in much smaller letters it also says “ for nandos etc
These signs tho are sited low if in an suv ( yes groan i have a Range rover sport so shoot me)
The signs are at below bonnet eye sight line and are at bumper height so when driven nose in you end up blocking the sign so cant read it
Nandos was shut at the time anyway so i was not stopping anyone from parking.
Unfortunaltly i came accross this website AFTER. I had replied & appealed. I have today read the newbies section but if im honest its confusing
There seems to be different rules if you get a windscreen pcn or like mine it came via post, trying to read and remember it all is quite honestly difficult. But what i have leaned from this site , is i wish to god i had the inteligance to have studdied law. It seems to have even a mild degree of how the laws work can save yourself a fortune.

Now that you are past the appeal stage, there's nothing to do but wait. The parking company has 6 years to decide whether to take this to court. Meanwhile you are likely to be harassed by debt collectors and people who did study law but are living proof that not nearly as much intelligence is required for that as you might think. The advice here is to keep all the correspondence but ignore the empty threats.
The time to act is if you get a Letter Before Claim. There are some other acronyms for LBCs so you need to check out the relevant section in the Newbies' thread so that you will recognise one should it arrive. In the worst case scenario - losing at court - you would not have to pay a great deal more and your credit rating would not be affected as long as you pay, contrary to what the debt collectors may tell you.
One thing's for (almost) certain, if you decide to fight you have time to gradually get up to speed on this game.
I think it might be a good idea to chew over a few aspects of all this one at a time. I'm no expert but I'm thinking the fact that the space was reserved for Nando's might make the signage 'forbidding' .... in which case the driver would have been trespassing, technically speaking. That's something you could look up and you'll perhaps get some (better) help here too.0 -

In what way is the NEWBIES thread post #2 confusing? We deal with Gladstones claims all the time and most posters use the NEWBIES thread to see what to do to escape these scams and come out the other side with no CCJ, no bailiffs, and paying nothing when they win at the local court hearing.
