Back out of EE upgrade and leave

Hi all
So yesterday I did some shopping around and long story short I have a virgin contract just started waiting to port my number across to and an EE contract that just got upgraded and started yesterday.
Now I'm nearly sure that because it was an over the phone sale for my EE upgrade that i have a 14 day cooling off period. When I called EE on 150 and requested to cancel the contract and get my PAC to port over to virgin the guy said I would need to pay out of my contract at ~£300. But when I gave off saying that surely I had a 14 day change of mind period they mentioned that I would have to call a 0800 079 8586 number. Get my account reset and then request my PAC.
Does this sound correct? And can I just leave without being penalised?

Normally so-called "upgrades" aren't covered by the 14 day rule as far as I'm aware (one network does allow it but it's not EE). Call the 0800 and ask.0

I don't think that the statutory cooling off period applies to upgrades, but EE may have a more generous internal policy.
Why not just call the number you were given?0 -
Just wanted to see what other peoples experiences were I used to work alongside Tesco mobile when I was on tescos tech team and never heard of anything like that. Just want to be as prepared as I can before I make the call. Plus that number is 20p per minuet so don't want to waste time on the phone."I have a job I just need more money":eek:0

If you've worked alongside a tech team, even an MVNO's tech team, you should know it's been illegal to charge for calls to 0800 numbers for almost 4 years now.0

"Upgrade" is just a marketing term for a new contract with the same provider (usually with a new minimum period and sometimes a new phone).
If you bought this "updgrade" by phone or internet the statutory cooling off period does apply. I'm sure you will see this reflected in their terms and conditions if you look.0
