we do not know the new government code of practice , however by watching/reading this ,is to do with PARKING tickets , not penalty notices0 -

Hi all, this would appear to be the (currently) definitive thread regarding Indigo/railway parking/byelaws/ITAL etc so I thought I would just let you know I also received a Penalty Notice from "PCN Admin Centre" (trading name of ZZPS) so not even from Indigo themselves(!). I have quite a few previously successful Indigo/POPLA appeals under my belt, so I recently lodged an appeal with ITAL/ASParking with the following:I am appealing as the Keeper. Neither the driver nor the owner of the vehicle are identified.
1. The Penalty Notice is headed "NOTICE TO OWNER". The owner is not identified. Only the owner can be liable for a breach of Byelaw 14. Having been sent to me as the Keeper and not the (unidentified) owner, this appeal, by me as the Keeper, should be upheld and the PCN cancelled.
2. The penalty notice states "an offence has been committed". Excuse me, but only a court can decide that. This assertion is deliberately designed to mislead, intimidate, and is shocking. I will be complaining to Transport Focus, the train operator and my MP.
3. No standing or authority to neither pursue charges or form contracts with drivers. Indigo have no legal status to enforce this penalty because there is no assignment of rights to pursue PCNs in the courts in their own name nor standing to form contracts with drivers themselves. They do not own this car park and appear (at best) to have a bare license to put signs up and 'ticket' vehicles on site, merely acting as agents for the Train Operator. No evidence has been supplied lawfully showing that they are entitled or assigned any title/rights to demand money from me.
Indigo are required to provide a full copy of the contemporaneous, signed & dated (unredacted) contract with the landowner. Any contract is not compliant with the requirements set out in the BPA Code of Practice and does not allow them to charge and issue proceedings for this sum for this alleged contravention in this car park. In order to refute this, it will not be sufficient for the Operator merely to supply a site agreement or witness statement, as these do not show sufficient detail (such as the restrictions, charges and revenue sharing arrangements agreed with any landholder). In order to comply with paragraph 7 of the BPA Code of Practice, a non-landowner private parking company must have a specifically-worded contract with the landowner otherwise there is no authority.
4. The amount being demanded is excessive. £100 for what would be an approx £8 ticket. This is a scam.
5. After having received Indigo's rejection of my initial appeal on [deleted] and during the 28 day period as advised in Indigo's rejection notice, I have started receiving intimidation notices from a company ZZPS. Instructing companies to start intimidating innocent members of the public, especially while appeals processes are still being worked through CANNOT be in compliance with the BPA code. I will include this in my complaint to Transport Focus, the train operator and my MP.
I request that my appeal is upheld and that ITAL inform Indigo accordingly that their speculative invoice must be cancelled.
Will let you all know how it goes. Of course, I am also aware of the 6 month timer. Cheers0
