Coupon-mad said:As expected. Read the telephone hearings thread and lots of examples of witness statements during July until it's second nature, so you have a fair idea exactly what you want to submit in August.
After reading the telephone hearing threads, have I missed submitting a Draft Order?0 -
Yes, the point of a draft orde ris to ask them to consider the CRA aspect now, no need for a hearing, and to then use your draft order as the basis for the real court order
You shouldnt need to submit anything more - evidence, WS4 -
Am I able to submit a Draft Order at this late stage??0
-
You could, but dont you see you need more than that?
A draft order goes alongside the part asking them to strike out due to the CRA2015 issues
you dont just send in a draft order.
Think about what youre asking ...3 -
Ah right yes OK.My main concern was that I’d missed a critical submission.I somehow missed reading up on a draft order when doing my research so I did not include and submit.
Would it be wise to edit my existing submitted documents to include a draft order plus the coupled necessary?0 -
The draft order is usually included when youre responding to a court documetn talking about a telephone or papers hearing, to get the court to look at it (as you know a judge is reading the submissions)
You could do it now, but I dont see it being that useful.4 -
Great, thanks for your clarity. I won’t proceed with it if it won’t have much effect. Thanks again0

Hi all, just checking in as 10th August was the date that was set for the claimant to have to pay the £80.00 court fees before September 7th hearing.
Are there any cases where this hasn’t been paid and the case has been thrown out?!0 -

I would say usually the Claimant does pay the fee. Occasionally the fee is paid a few days late, but the courts don't seem too bothered by that. Occasionally the Claimant pays but the court fails to record that properly.
The court isn't going to tell you whether they've paid or not unless you specifically ask.
In my opinion, just assume it has or will be paid.5 -
Agreed
Plus you asked the same question a month ago
Speculation is irrelevant , you can only react to what actually happens in your own case , wait and see !!!4
