You can explain this is per PCN in your WS, and state the maximum that is allowablce
Major in court that claiming sums to which you are NOT entitled and you must know it - as parking companies know - is an abuse of process. The usual sanction for abuse would be to strike their claim out.
I mean, IN COURT. Not before.
Yes, you send to the solicitor. NEWBIES THREAD, POST TWO takes you through the ENTIRE process.
Thank you again for your help, I'll certainly remember to do this in court.
Also, I sent the DQ back in Feb and despite me stating my 'address in service' multiple times throughout this entire process so far, Gladdtones sent their DQ (dated January) to my previous address. It was only brought to my attention today and I've picked it up. I've had a read through and like you guys have stated, they wrote they would like the matter to be dealt with on papers. I requested an oral hearing in my DQ. Do I need to follow this up to ensure it will be a oral hearing? I sent the DQ back in Feb and haven't yet heard anything back from the court regarding a court date either. I presume it takes a while?0 -
Hmmm, that's a long time so I would ring the CCBC if you haven't heard it's been allocated to a local court yet. I worry they too are using your old address...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just as I was about to call for an update, I received a letter which says the claim has been struck out by a judge. Is this good news and can they appeal and re-open the claim?0 -
They can appeal within the timeframe the letter gives them.
But I hope I am not premature by congratulating you on winning the case and saying ANOTHER ONE BITES THE DUST!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I've given it a few weeks buffer time in case they did appeal and I was inadvertently waiting for that notice to come through the post, but they had 7 days to appeal from mid April and I've not received anything plus a quick call to the court informs me they haven't lodged an appeal within the 7 days either so touch wood, I would like to say they have dropped it :T
Myself and my partner would like to thank everyone who took the time to read our posts and advise us as well as you all have - it's a massive weight off our minds as there were quite a few PCN s somehow which would have been a nice payday for the other side had they won.
Thank you for all that you do to help out, it does not go unappreciated :beer:0 -
Great to hear that success. This is why we come here every day!
