Letter from ZZPS

I recently parked in a train station car park, ran by Indigo parking, As always I ran for the train, then the app would not work, for me to pay for parking, it would just not login. I sent a text to my wife for her to pay via her app, but there was a delay of about 40 minutes before she bought the ticket, shortly before a parking warden gave me a PCN notice which I found when I got back to the car despite paying for the ticket on the app. I appealed the notice, Indigo dont allow you to appeal unless you tick the 'Im the driver box' I explained the situation that their app was to blame and delayed me buying a ticket, they can clearly see my wife bought the the ticket via their app, but as expected they refused my appeal. I asked if the reduced amount was available and never received a reply, forgot about it and now Ive got a demand for £170 from ZZPS. Firstly is there anything I can do, given Ive admitted being the driver? Surely their app not working and their phones never answering should count for something in the eyes of the law. SHould I just bite the bullet and pay, which I really dont want to do, as I feel wronged here, or can I fight this and how...?

    just IGNORE ZZPS and let it time out after 6 months

    see the NEWBIES FAQ sticky thread, post #4 for advice on ignoring debt collectors

    and read the INDIGO RAILWAY STATION info about this sc@m on land covered by bylaws, its a complicated issue, so dont let your head spin

    the important thing is to get it past the 6 months deadline for court

    Please do a search and read the dozens upon dozens of (use these keywords in your search) 'Indigo Railway' car park threads. The advice is all the same throughout - please follow it. You need to time this out beyond 6 months so no criminal prosecution is possible.

    HOW TO USE THE FORUM SEARCH FUNCTION:

    Hit your 'Back' button to get back to the forum thread list. On the bar just above the threads you'll see the 'Search' function. Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.

    Nobody here will advise you to pay a scammer.

    If their payment system was faulty, that's their problem as it caused a frustration of contract.

    It's a shame you revealed the driver's identity. There are normally options other than I was the driver on appeal forms, and if there isn't, there are still ways round it, like sending an appeal by post.
    In addition, having no option other than to select Driver should result in a complaint to the BPA and DVLA.


    It's also a shame you didn't appeal to PoPLA. Never mind, all you have to do is get this past 6 months, assuming the railway car park belongs to Network Rail or the Train Operating Company, because byelaws will apply.
    If that is the case, Indigo can't take you to court and cannot pass your details to the landowner or TOC.
    After six months, byelaw cases become statute barred.
