Rail Station Parking Ticket - Can I appeal!?

Hello,

Looking for advice please. The driver received a parking ticket at a train station today for parking in an unmarked bay. The space where the driver left their car left plenty of room for all other drivers, was not on yellow lines but was not in a marked out bay.

The driver looked for the terms and conditions of parking when leaving the car park and found they were not clearly presented.

The ticket is a "Penalty Notice" issued by Indigo Park Solutions on behalf of Govia Thameslink Railway.

The keeper would like to appeal this charge but would like to know how likely it is for the appeal to be successful, or for the ticket to be void.

    the KEEPER will be appealing this on day 26 from now

    do not tell anyone who was driving, nor who the owner is , stay in KEEPER mode
  • and get an appeal in , the one from the template in newbies , you want a POPLa code , take your time ,

    normally we3 say do this about day 26 , however I now think to leave it until THEY write to you , they cannot do this until day 29 onwards , then an appeal , taking your time , then a wait for a POPLa code , spring will be here soon (5 mths timeout)

    Yes I think with INDIGO at railway sites, as long as the car is yours (not leased/company/hired) then wait for the first letter to keeper which might not come till after Christmas.

    THEN wait until VERY near the appeal deadline in that NTK and appeal as keeper, using the NEWBIES template appeal, and get a POPLA code.

    That tactic gets you half way to timing the out (6 months and it's void) just by taking your time. And you will probably win at POPLA but if not the 6 months will be almost reached by that time!

    No-one pays these scam fake penalties.

    Thanks everyone! I really appreciate your help. I've read through the NEWBIES post and just want to confirm I've got it all right...

    1) ignore the "penalty notice" for now and wait to receive NTK.

    2) Appeal NTK as late as possible using the template

    3) Wait for POPLA code and appeal with POPLA using template on the forum

    4) Ignore any threatening/debt collecting letters and wait out the 6 month time period

    5) Contact Indigo at the 6 month period to remind them they can no longer pursue the charge

    Then just hope this all takes 6 months. I think I've chosen the right time of year - assuming their office may shut over the Christmas period which allows even more time to pass!

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    You still need to edit your first post as already advised. Only ever refer to The Driver, the Keeper, and The Owner, who are three different people. Don't mention The Owner yet though.

    2) Yes and (No)The initial appeal comes from The Keeper, not The Driver. Copy and paste and send. Do not edit.

    Delay everything as long as possible before appealing, hence day 26 after receiving the NTK, and as near to the end of the PoPLA deadline as possible.

    Things have recently changed with regard to Byelaw cases, so we all need to see how this plays out. Don't rush it as the regulars may come up with new ideas when we see what the scammers do now.

    Please do complain to your MP as well. Have a good look at the info The Deep has posted to see what our MPs have to say about these bloodsucking scammers.

    no , nothing else , no matter what you say or do , they will not back off , there only income is from the likes of you

    all you want is a code in order to take this to popla , where when you say the magic word "bylaw" , they will scurry off , and continue munching garlic
