PCN from Parking Eye

I went to Manchester airport as collecting a friend.

I know MA rather well so I decided to sit and wait for my friend in the Crowne Plaza Manchester Airport.

I chose a Blue Badge as I have a badge.

I did not get out of the car as was only waiting for my friend to turn up.

It would appear I was there for 31 minutes.

Quite honestly I didn't notice any notice although I was concentrating on driving rather than notices.

Sat in the car I did not spot anything obvious that I was not allowed there.

Plus staff saw me and nothing was giving me any indication I shouldn't be there.

Received a PCN with parking charge amount £100 or £60 if pais within 140days.

Am I able to appeal this or have I basically done wrong and should pay the charge?

    I'm looking at the template to appeal a "fine".

    it gives the following options but I don't think mine circumstance is covered here.

    I am appealing as was sat in my car and did leave my car there unattended.

    "• The alleged contravention did not occur
    Quite simply, the parking attendant got it wrong and the vehicle was not parked inappropriately at the time the ticket was issued. This is due to the fact [insert reason here]. Please see attached evidence, [explain your evidence here & include and refer to documentary evidence if you have any], as proof of my claim.

    • There was insufficient signage
    The car park in question has no clear signage to explain what the relevant parking restrictions are. This means no contract can be formed with the landowner and all tickets are issued illegally. Please see attached evidence, [explain your evidence here & include and refer to documentary evidence if you have any], I have gathered as proof.

    • The vehicle was not parked on the land in question
    You issued a ticket for supposedly breaking your parking restrictions yet the vehicle was actually parked [insert where you parked] meaning you had no authority to issue a ticket. Please see attached evidence, [explain your evidence here & include and refer to documentary evidence if you have any], as proof.

    • Mitigating circumstances
    There are mitigating circumstances to explain why the vehicle was parked where it was and the charge should be waived for this reason. Please see attached"

    Ive just been on their web site and it looks like even paying guests have to pay £15/day for parking.

    Think I may have worked close by there.
    That kinda defeats the reason which was avoid walking too much. Ah well I now know for next time.

    to win at popla you need to win on a legal technicality (like contracts , signage etc), if you fail the £100 charge stands and the PPC could take it to court within 6 years

    we would advise you to go to POPLA, and all the info you need is in the sticky thread for NEWBIES, near the top of this forum, please read it

    you are unlikely to be able to negotiate with them

    try and get the landowner to cancel itif you were a patron


    bear in mind your BB has no relevance at all on private land, check your blue booklet

    Also can anyone advise me what to put in the appear letter where it shows “asking for exceeds the cost to the landowner” I’ve no idea of the parking fee despite trying to find.

    I have honestly tried and am struggling, so can anyone help or guide me here please?

    Yes you can appeal, but not by using the one from the general MSE website, you must use the one in the NEWBIES FAQ sticky, post #1, accessed from this sub-forum's thread list page, one back from this one.

    This appeal will be rejected, but it will open the way to a POPLA appeal. Whether you can win there will depend on technical argument which you will need to research on this sub-forum. But please note that neither your blue badge nor the fact you didn't leave the car are of any help to you.

    Trying to find out what the 'parking fee' is/was is a futile exercise as it has no bearing now - the charge now is £60/£100. Don't be distracted by any further search for something that is now irrelevant.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
