Hermes getting away with theft

    In the same way that’s it’s your responsiblity to take out an insurance policy when eating at a restaurant in case the chef gives you food poisoning?

    There are laws governing health and safety and public services apropos restaurants supplying food that is going to make you ill.

    Perhaps it would be easier for you to liken it to your house burning down and having no contents cover.

    Put it another way.... you take your £40k BMW in for a service at your local independent. On returning to pick it up the garage can’t find it. Would it be reasonable for the garage to point out that they weren’t responsible as in the small, print they excluded German cars?

    Would any of the depot staff know that a package contained a 27" monitor and not a 21" one?
    A 27" monitor is hardly the sort of thing that someone would easily be able to sneak out of a depot without being noticed especially as there's a good chance that there is cctv installed and in reality, how much is a second hand monitor of this size worth and would someone risk their job and a criminal record over it when there are probably far more expensive and easier to conceal items to hand.

    It might be something as simple as the shipping or tracking label has come off and the package has been put someone "safe" by someone who is now on holiday.
    If it was a hugely expensive item then they might spend a little more time looking for it but I can't imagine they would spend too long on a missing monitor.

    I shipped it in the huge box of my new LG 30 inch monitor which costs £1000 - the box was not covered up so it obviously would have looked like an attractive item. This never occurred to me being an issue until now that is lost

    If the list was purely about accidental damage, I would not have complained. But there is no sensible explanation for listing items which are fair game for loss or theft. 21" vs 27" - really?!?

    Disagree insofar as yes the restaurant would be breaking the law but a customer would claim on a civil basis rather than crimminal one, as such would you be happy for a restaurant to be able to deny the claim as the customer hadn’t taken out ‘food poisoning’ insurance?

    As regards the house burning down.... if it was caused by the boiler repair man doing a poor job I wouldn’t expect to be denied compensation because because I hadn’t insured against his dangerous work.

    Can a company overrule any consumer rights by making up their own terms - regardless how little sense they make and how inappropriate they are?

    It’s about reasonable.

    I genuinely can’t think of any other service where this would be allowed.... if a dry cleaner lost your expensive coat could they refuse compensation if you hadn’t taken out ‘we lost your item’ insurance.

    I suspect it's easier to just exclude certain items from coverage altogether instead of trying to cover them for loss and not damage. It'd be very easy to "lose" a damaged item that isn't covered for it. It also makes the terms and conditions easier to comprehend - for both sides.
