CCJ County Court Business Centre

Hi everyone
Can someone please help my dad with a CCj he received from county court business centre Northampton.
My dad owns a taxi and received a PCN from VCS for an incident which he doesn't recall. The offence was stopping in a industrial estate on a road which apparently says no stopping or £100 fine.
The picture shows a passenger alighting the vehicle. So im guessing they were being dropped off.
Firstly he has total of 3 drivers on that vehicle so we dont know who was driving.
Secondly someone told him to ignore it and now we have received a claim form from County court bussiness centre northampton asking for £160 claim, £25 court fees total £185.
I have made an MCol account and acknowledged the letter, not submitted a defence yet but im struggling to find a case similar to mine as the passenger was obviously involved. This is usually a matter of minutes whilst someone alights and closes the door.
Can anyone please help us? We would be very grateful.

Date of issue of the claim please? (Top r/h side of the claim form).
Do some searches on the following keywords to bring up similar threads.
'Liverpool Business Park', 'Liverpool John Lennon Airport'.
This is quite complex and somewhat different from standard parking charges that you (or more importantly your father as it's his case to defend) will need to understand. It is a 'no stopping' charge, which is, very arguably, not what PPCs have authority to access keeper data from the DVLA via their KADOE contract - but that's a sideshow at the moment. As most cases here are about parking per se, and lots of the advice in them will still apply, there are subtle differences.

If VCS have done everything correctly then whoever was driving is now irrelevant. Legally they can pass the cost on to the registered keeper.
Can you also post up the particulars of claim please?0 -
With a Claim Issue Date of 19th December, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 21st January 2019 to file your Defence.Issue date 19 Dec 18.
That's nearly three weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
- Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
Everywhere I have said 'you' or 'your' I do of course mean the Defendant.0 - Sign it and date it.

Thanks for this waamo. Once I started linking airports into the suggested searches for the OP my brain switched to bylaws and not relevant land, which won't be appropriate to a business park stopping case.
@OP - please read my edited post #2. Sorry for any misdirection. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi Chaps
so i found a similar case to mine, also which occurred at Calder Park, Wakefield. I cut and pasted a defence and submitted it on the MCOL
website. They accepted it and sent me a DQ Late January. However i have received a letter from VCS today to say they had made an error and the case had been dropped. Do i believe this letter or continue with the Court issued DQ??? Any advice welcomed.
Thanks0 -
Until the court says it's over it isn't. I would send a copy to the court.0
-
I would normally say send your completed DQ to the court to the same email address that you sent your Defence, by as you ignored my earlier suggestion, I won't bother.0
