New to this forum so pls don’t shout. Trying to figure out exact process to follow to appeal but finding this forum confusing to find stuff, taken me ages to know how to post:)
So I think I finally found the Newbies thread everyone refers to but worried as it seems to date back to 2013. Is there just the one template letter for appeals? If anyone could copy and paste it here or a link just to confirm that would be great pls.
Brief story, got a PCN from Euro through the post for over staying in car park by 11 minutes. In all honesty my pram wouldn’t fold to go in the boot as button broke then baby had a melt down! Had I of known they had cameras monitoring the in/out time I would have tried to be quicker!
Anyone can’t afford £100 which I do this is a rip off so would like to try and appeal. Sorry if this is duplicate to other posts. Any advice much appreciated. X

A - YES, IT IS. SEE THE DATE LAST EDITED IN 2018 AS SHOWN AT THE BOTTOM OF THIS POST.
Send the blue text template appeal you have already found.
Send it unchanged - no additions or alterations necessary.
Send it as the keeper.
At the same time complain to the car park owner.0 -
The NEWBIES is up to date. It tells you itself how to confirm this by checking the last time it was edited which is shown at the bottom of each post.
There is only one initial appeal template and it's in post 1 of the NEWBIES, and it's in blue type.
You should edit your post to remove information about who parked, had problems with their pram etcetera. Only ever refer to The Driver and The Keeper, who are two different people.
If an occupant of the car was a nursing mother they may qualify under the Equality Act 2010, and should therefore be given extra time.
In any case, there are grace periods for parking that should also apply.
Please confirm the full name of the PPC as there are many with similar names. I can think of at least three.

and edit post #1 on a laptop and remove any hint of who was driving or who may have overstayed
the 11 minutes alleged overstay can be made up of say 5 minutes to park and read the signs etc, and up to 10 minutes or so to leave once the parking was completed, so 2 grace periods, one before and one after
this will help in any POPLA appeal down the line

They have 35 days to respond.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
Thank you. Is it worth complaining to my local MP too? obviously not divulging any details to the charge but I feel so sorry for all the innocent people especially more older or more vulnerable people that are just paying these fines. Makes my blood boil.
I went back a few weeks ago and discreetly took pictures of the signage etc and in all honesty where it says in small writing “Camera Controlled” to me and other innocent members of the public I assume the cameras are for your cars safety! How foolish am I! It’s deceiving.
Let’s hope the law changes soon.0
