BW Legal - Britannia - PCN - University Car Park

Hi all,

During my time at university Britannia parking have issues 5 PCNs against a car they believe to be owned by myself for parking in a supposed non student car park. This car park is not pay and display but operates on a permit basis.

All the usual Britannia letters and DRP / Zenith collection letters came through. These were ignored.

It has now been passed to BW Legal who have sent a 'LETTER OF CLAIM'.

I have sent a SAR to Britannia and have received the response. I asked BW to put the case on hold which they declined to do.

My question is - BW Legal have only sent the LETTER OF CLAIM for 1 OUT OF THE 5 PCNs against me. Should they be handling ALL of these PCNs within one claim letter? or are they allowed to do this multiple times?

I have read the NEWBIES post through and through but am unsure what steps to take next.

Any help would be appreciated, I can afford to pay one, but not 5 !!

    they can do this one at a time, drip feeding, they could even try issuing 5 court claims if they wish, at different times

    all you can do is keep rebutting their assertions and also sending a SAR to the ppc to get all the data they have on you (the SAR you sent should obtain the paperwork etc for all of these pcn,s)

    this is a game of tennis you are in, ping pong, with few rules, you are only partway through the first half of the game , the final whistle could be a decision by a judge, which can take months, so settle in for the long haul, its all a part of the game you are caught up in
  • Thanks, the SAR failed to provide photos of the signage on the day of each PCN, Instead the signage photos were dated 5 months prior to the first PCN.
    The SAR also failed to provide proof that they have paid a debt collector.
    Do they have to provide photos of the signage on the day of each PCN?
    This car park NO LONGER Exists and has been built over, there were also construction works happening in the car park during the time of the PCNs which likely affected signage.

    when it gets to the WS and evidence stage of any court case, they would be expected to provide the court and you with those pictures etc, especially if you have put them to strict proof in your initial defence

    I suggest that you read the walkthrough by member BARGEPOLE so that you know how this works and what is provided and when

    the judge is expected to look at the evidence, including contracts and pictures of signs etc and then decide the outcome

    you wont get those pics in a SAR, a SAR gives you all their data on YOU, not the whole shebang, although you can ask them or their legal team for these pics and docs etc in the preamble to court, due to the PaP rules oct 2017 amendments

    the chances of them having pics of the signs on that day are unlikely, but they can simply sign a WS stating that those signs were erected prior to the incident date and remained unchanged since then, or words to that effect. the judge is likely to believe that signs erected 5 months prior also existed on the day in question, which is common sense

    you need to realise that they get the chance to provide the WS and their evidence a few weeks prior to the court case, as do you, until then its all smoke and mirrors

    the last thing you need to realise is that they have to convince a judge that they have a valid case, but you cannot expect them to lay all their cards on the table until say 2 weeks prior to the court hearing

    its a game, which they have played far more of than you
  • I've got the SAR and I've also been sent photos of the signage in a separate email. So I presume I now have all of the evidence bar the WS.

    Britannia have refused to provide evidence that they have paid a debt collector and state that this is not required and that the £60 increase will be honoured in court.

    Unsure how to proceed.

    if you have those data details from the SAR then you should issue an LBC rebuttal to B W LEGAL, if you have not done so already

    then you play ping pong with B W LEGAL until an MCOL comes in the post, at this stage its a tennis match, backwards and forwards, who blinks first

    you dont proceed with anything, you are waiting for them to proceed with an MCOL and meanwhile you keep knocking the ball back, waiting for the main game to start

    this is the warm up session, where each opponent eyes up the other one , like 2 rutting stags sizing each other up before locking horns

    How would one issue a rebuttal?

    by reading the dozens or hundreds of other B W LEGAL threads on here and doing what they have already done, by email

    I assume that as a uni student you are fully conversant with reading and research and drafting your own paperwork, like at UNI ?

    How would one explain 5 separate PCNs ?

    you dont, certainly not at this stage , why would you help the opposition to win ?

    The car was owned by myself up until a year ago.
