Tenant in an annexe, council issues

    So your home is not really an "annex" (in planning or CT definition) but either a static caravan (usually metal exterior and not really suitable for year round living) or a mobile (or park) home (usually roughcast exterior and designed for year round living).
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I can't see how an annex with no insulation can possibly meet the EPC rating minimum of E for properties being let. The landlord knew what he was doing was illegal before he even started on this.



    Someone needs to report the landlord to the council anyway because charging £1400 pcm for an uninsulated shed is disgusting.
  • I am so confused, I am not sure what to do.
    Only I want a calm life for my family. We have a 1 year old toddler as I mentioned. And we are not that kind of people who makes or takes conflicts.

    What do you suggest to do?

    For example, if we move in his house (as he asked us to do to avoid enforcement notice) until we find a new home, shall I pay rent? I do not think so.

    If he let the house illegaly, our contract is illegal as well, isn't it?

    So nice gift for the end of the year...

    In respect of the tenancy and CTax - if the property was banded for a period you were in occupation then tenancy agreement (or lack of) makes no difference to the council tax liability (as residents it would default to you anyway in those periods).
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I am pretty sure it has not been banded.

    Once we had arguement about the bins (took ages to get them), he emailed me this:

    The tenancy agreement says that council tax is included but that does not mean you pay it. There is only one council tax for xx (hete was their house's name) which we pay in full. You contribute only in as much as you pay us rent. This is slightly splitting hairs, I certainly am not looking to argue over this.

    It almost certainly hasn't been banded but it will be, as to what date they use time will tell.

    As your home is not an "annex", then the CT band can be backdated and you would be liable for paying CT from the start of your occupation.
