Scam advert on FB for Niffler necklace

Hi, I have recently joined to get advice on how a fake advert and in turn it’s page selling the item can be closed down.
A FB advert is linking to a website claiming that they are selling a niffler necklace.
It appears to be an advert business page called I Love Movies and has a link to a website.
The selling website is bembig.com and it’s the Niffler necklace.
It is fake, the images have been stolen from aishavoya.com and the owner of that site posted loads of times on the FB advert along with a load of us warning people not to buy.
No negative comments are ever replied to, even with the proof. They are just depleted and the poster gets blocked from posting.
We’ve all now been blocked from posted on the FB advert but can still view it, I get notifications and can see loads are posting as it’s being shared and liked all over.
This has been going on for about three weeks now.
Any negative posts are deleted by the FB ad owner. FB don’t appear to be doing anything even though it’s been reported numerous times.
It’s got over 6k likes, 595 comments and 794 shares, growing al, the time.

As a comment people are buying it, mostly through PayPal. We managed to warn a few people we could see had commented bought and messaged them via FB with the proof so they could try for a refund.
So far only those who put the dispute via PayPal got a refund.0 -

The Harry Potter franchise is quite litigious and have lawyers working for them who are experts in this field - this is quite an interesting article:

Hmmm, polymer clay is usually a sign of a 'fan made' item and not a licensed one. I'm beginning to wonder if aishavoya.com are actually complaining against a seller stealing their idea when they in turn stole it from the license holder. Obviously I don't know that for sure but it would be ironic if that were the case.

OP if you do not have permission to use the Niffler image and name you do realise that being sued could cost you thousands of pounds.

My friend shared it on fb after she bought it, and when we were looking at it more i spotted a post that got deleted quickly, then on reading posts that got deleted minutes are being posted we realised it was a scam.
The person who made it sold it over a year ago and it’s quite easy to find on both fb and the internet as it went viral last year.
The issue is that people are ordering an item that doesn’t exist and so are being scammed.
You’re right that the original creator doesn’t own the copyright, but that’s not the issue here.0 -

Also we contacted the original artist who replied and said they got blocked. One of my friends said she/he replied to a fb messenger message but that they tried and got nowhere so basically they clearly don’t care the image has been stolen off them and is being used to scam people.0

The returns policy on that site is one of the funniest I've ever come across. It looks like witches and wizards don't have the same consumer rights as us mere muggles. :rotfl:

None of this makes any sense! If you have no connection to the company then what is the issue? Both the original company you bought from and the other company are selling these against copyright , both are at fault- it doesn't mater that one company stole the idea first.
To make it clearer both companies are so bad, so poor in their consumer rights and so acting illegally that it doesn't matter which one started it. Even odder is that the other company doesn't even have a returns policy nor do they show any contact details at all - both companies look very very dodgy - like a lot of those odd ones you see pop up in your feedback feed!
