Argos refusing to accept a return after misleading information

I bought the lenovo e7 tablet from argos literally an hour ago. It is a cheap tablet, currently at £49.99. I bought it online and checked the listed android version which is stated as android v7.1.1 or better known as android nougat. However on getting it home and setting it up, I discovered it was actually android 8, or rather android oreo which is a light version of android and meant the tablet was unable to run the apps I wanted it for.
I immediately took it back and was refused a refund, despite explaining about the incorrect Information on their website, due to the fact I had turned the tablet on, which apparently invalidates it for a return as it must be in 'unused' condition. I didn't even want a refund, I wanted to pay ten pound more for a different model of tablet.
Now as far as I'm aware, due to misleading information, they should return anyways, whether I turned it on or not. What can I do about this? I called their customer service and asked to be put through to their complaints department which immediately cut off!

You bought it, took delivery and tested it, returned it and came home and posted here. All within an hour?0 -

By better, they mean Android v7.1.1 or later. Android 8 is a later version. Therefore providing a laptop with Android 8 would fall within their description of "Android v7.1.1 or better".
Edit.
Just re-read. Do you mean it was described as "android v7.1.1, or better known as Nougat" or did you mean "android v7.1.1 or better, known as Nougat"? How exactly - including punctuation - was the description worded?:heartpuls Mrs Marleyboy :heartpuls

I missed the obvious in the bizarre timeline!
Edit -- I see you have also edited now.
That aside, OP, if you want to change your mind and you purchased in-store, then you need to adhere to their returns policy, I have no idea what that is, do you?0 -
Is it the one at https://www.argos.co.uk/product/8458393 ?
If so it doesn't actually say 7.1.1 or better it just says 7.1.1.
That being said with only 1GB of RAM it'd probably have problems running a lot of apps even if it still came with 7.1.1.0 -
Erm yes? My local argos is ten minutes away, I bought by click and collect, collected it by car and brought it home, then as soon as I realised it was not the operating system it stated it to be online, I took it straight back. I'm afraid I didn't time myself as I was unaware I would need to for posting for advice on here.0

The operating system was listed purely as android 7.7.1. Nothing more, nothing less.0

Assuming that the in-store description states this too I'd be tempted to reject the tablet under section 11 of the Consumer Rights Act "Goods to be as described."0 -
Did you pay online or in store?0

I paid online whilst on the way, collected when arrived.0

[QUOTEHi Maxine, I am sorry to hear you had an issue with a product purchased from ourselves. At the time of the details being sent to us about the product it would have been running 7.1.1 but clearly has updated since then due to the automatic update process of Android. We cannot return digital products which are not faulty due to the fact we cannot be responsible for any customer data on the device and due to this it cannot be resold.
In regards to being 'fit for purpose' the machine would still indeed be so as it is would operate perfectly in the way it was designed to do so.
We can only apologise for the error that was on the website as we clearly had not been informed by Lenovo they were now despatching devices with Oreo. I shall pass this on to the web team to get updated. - Mal[/QUOTE]
