Yes I have thanks. eBay tracking just shows loads of 'enquiry resolved' since I've been calling MyHermes for updates etc.

what does it say if you track it here?

Just the same as the eBay tracking history, minus all the 'enquiry resolved' statuses.
I don't understand how it can be lost. Surely it's moving around somewhere and thus must be getting scanned. Unless it's been pinched of course.

The technical answer is that you would not be able to close the account until 180 days after the last transaction has occurred to give time for all types of chargebacks.

Oh ok I understand. My gut is telling me eBay will side with me but PayPal will not. I tried to call PayPal today but the wait time is no less than 8 hours :rotfl:

No need to phone if no case has been opened yet.

I just thought I'd try and get ahead of it as what I did with eBay had put my mind at rest a bit.
But yeah, I totally get what you're saying. I think it's getting to me because a lot of thing I'm finding on the net say that the buyer (in the PayPal world is king) and often disputes go in their favour immediately. I'd just like to try and get a head of it if possible I guess.

Paypal has an absolute policy, buyer WILL get a refund if item doesn't track online to show delivery. Ebay are the same but occasionally do some odd things, however their message as cut and pasted by you still doesn't confirm that they would cover you against a claim and I still think you stand a very good chance of losing an INR. This is the ebay policy:

    https://www.ebay.co.uk/help/selling/managing-returns-refunds/helping-buyers-items-not-received?id=4116

If a buyer doesn't receive their item, they're entitled to a refund unless you can provide tracking information showing that it was delivered.

Then here is the buyer guarantee, and note there is no provision for buyer opting out of this via email messages:

    https://www.ebay.co.uk/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee?id=4210

When does eBay Money Back Guarantee apply?
You're covered under eBay Money Back Guarantee when:

    You don't receive an item
You receive an item that doesn't match its description in the listing
You receive an item that's broken or faulty

Ok, so buyer has now opened a case. I called eBay and essentially the agent agrees with my logic that the buyer opted out of having insurance.
However the agent told me that the process for this sort of situation (eBay seen both the seller and buyer are not at fault) is the buyer is refunded first then an appeal is opened and the seller is refunded also. I was dubious of this but seemed like the only way for me to accept.
So the buyer has been refunded and after 24 hours the agent will automatically appeal for me and then issue me a refund. Apparently the agent had had many cases like this and this is the way she usually performs the refund with no issues.
We shall see what happens, I'm 50/50 on whether she was taking me for a ride to be honest.

    Soooo....

eBay refunded both me and the buyer! Happy days for the pair of us and faith in humanity is restored.

I know a few of you would say I was lucky - perhaps so - but I feel it was a fair result that and eBay have done brilliantly.

Thanks to everyone for the advice and information!

Yes I think you were lucky, but ebay have been doing some strange things recently as I stated earlier. I had a goodwill refund on a return where I thought buyer was scamming me, ebay paid the buyer out but did not charge me - so it does happen.

At least now you know that insurance is for your benefit and not that of the buyer and you can decide whether to continue selling to Italy or, as many of us have already done, block the country entirely.

    Yes, lesson learnt

To be fair to the Italians, the parcel has stopped moving at the UK side.
