So I've received a letter from BWLegal. It doesn't say "Letter before Court Action" but does say that if no payment/explanation given within 14 days they'll ask Britannia for permission to commence legal proceedings.

I've sent an e-mail to BWLegal saying that I am awaiting Data Protection information per the big original post. Should I do anything else at this point?

Keep an eye on other Britannia/BWL cases to get the latest manoeuvres and developments - yours is likely to follow the same path. You mustn't remain on your own thread and expect regulars to update you every time there is movement in your own case.

We read every thread and contribute to most, yet none of us have an impending court case against us. You only need to keep tabs on Brit/BWL cases.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi all, I have received a letter titled Letter of Claim dated 31st of May and giving me until July 5th to respond, also including some response letters.

I've read through some posts and the main thread but I admit I am a bit confused what I am meant to do. I've already issued and completed an SAR though they were late and did not give me the unredacted Machine listing just the redacted version. I have put in a complaint with ICO about it and with the DPO for Britannia.

Now am I meant to complete these inclued forms by ticking the box saying I dispute the debt and then just send it back?

Because reading some of these topics it seems like people get a Letter of Claim and then send their full defense to the legal team? Can someone just let me know if I should just tick the box and send it? Apologies, there's a lot of info to take in.

    No.

No. You haven't got a claim form yet so you can't defend yet.

In the NEWBIES thread there's a paragraph or two underneath the bit about sending a SAR, and it starts:
DO RESPOND - but DO NOT use the 'reply forms'. You do not have to declare your finances!

Just reply saying you are 'seeking debt advice' as that buys you another 30 days with the case on hold, which you can use to research defences here and read threads about court wins every week.

This is a good idea only if doing a defence in July will be better for you (not if you will be on holiday or course!).

Thanks Coupon. So beyond that I don't need to do anything (beyond build a defense) and wait for them to make an actual claim?

Try 'defence' (unless you're being pursued through the US courts).

A lifetime of watching American films has left me weak against 'z' versus 's' and defence and defense. Good with my coloUrs though.
